1 AN ACT
2 RELATING TO SPECIAL MOTOR VEHICLE LICENSE PLATES; AMENDING SECTION 49-402,
3 IDAHO CODE, TO PROVIDE A CODE REFERENCE; AMENDING CHAPTER 4, TITLE 49,
4 IDAHO CODE, BY THE ADDITION OF A NEW SECTION 49-418E, IDAHO CODE, TO
5 ESTABLISH AN IDAHO ELKS REHABILITATION HOSPITAL SPECIAL LICENSE PLATE PRO-
6 GRAM; AND PROVIDING AN EFFECTIVE DATE.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. That Section 49-402, Idaho Code, be, and the same is hereby
9 amended to read as follows:
10 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup
11 truck, each neighborhood electric vehicle and each other motor vehicle having
12 a maximum gross weight not in excess of eight thousand (8,000) pounds shall
13 be:
14 Vehicles one (1) and two (2) years old ............................ $48.00
15 Vehicles three (3) and four (4) years old ......................... $36.00
16 Vehicles five (5) and six (6) years old ........................... $36.00
17 Vehicles seven (7) and eight (8) years old ........................ $24.00
18 Vehicles over eight (8) years old ................................. $24.00
19 There shall be twelve (12) registration periods, starting in January for
20 holders of validation registration stickers numbered 1, and proceeding consec-
21 utively through December for holders of validation registration stickers num-
22 bered 12, each of which shall start on the first day of a calendar month and
23 end on the last day of the twelfth month from the first day of the beginning
24 month. Registration periods shall expire midnight on the last day of the reg-
25 istration period in the year designated by the validation registration
26 sticker. The numeral digit on the validation registration stickers shall, as
27 does the registration card, fix the registration period under the staggered
28 plate system of Idaho for the purpose of reregistration and notice of expira-
29 tion.
30 A vehicle that has once been registered for any of the above designated
31 periods shall, upon reregistration, be registered for the period bearing the
32 same number, and the registration card shall show and be the exclusive proof
33 of the expiration date of registration and licensing. Vehicles may be ini-
34 tially registered for less than a twelve (12) month period, or for more than a
35 twelve (12) month period, and the fee prorated on a monthly basis if the frac-
36 tional registration tends to fulfill the purpose of the monthly series regis-
37 tration system.
38 (2) For all school buses operated either by a nonprofit, nonpublic school
39 or operated pursuant to a service contract with a school district for trans-
40 porting children to or from school or in connection with school approved
41 activities, the annual fee shall be twenty-four dollars ($24.00).
42 (3) For all motorcycles and all-terrain vehicles operated upon the public
43 highways the annual fee shall be nine dollars ($9.00). For operation of an

1 all-terrain vehicle or motorcycle off the public highways, the fee specified
2 in section 67-7122, Idaho Code, shall be paid. Registration exemptions pro-
3 vided in section 49-426(2), (3) and (4), Idaho Code, apply to all-terrain
4 vehicles and motorcycles used for the purposes described in subsections (2),
5 (3) and (4) of section 49-426, Idaho Code.
6 (4) For all motor homes the fee shall be as specified in subsection (1)
7 of this section and shall be in addition to the fees provided for in section
8 49-445, Idaho Code.
9 (5) Registration fees shall not be subject to refund.
10 (6) A financial institution or repossession service contracted to a
11 financial institution repossessing vehicles under the terms of a security
12 agreement shall move the vehicle from the place of repossession to the finan-
13 cial institution's place of business on a repossession plate. The repossession
14 plate shall also be used for demonstrating the vehicle to a prospective pur-
15 chaser for a period not to exceed ninety-six (96) hours. The registration fees
16 for repossession plates shall be as required in subsection (1) of this section
17 for a vehicle one (1) and two (2) years old. All other fees required under
18 chapter 4, title 49, Idaho Code, shall be in addition to the registration fee.
19 The repossession plate shall be issued on an annual basis by the department.
20 (7) In addition to the annual registration fee in this section, there
21 shall be an initial program fee of twenty-five dollars ($25.00) and an annual
22 program fee of fifteen dollars ($15.00) for all special license plate programs
23 for those license plates issued pursuant to sections 49-404A, 49-407, 49-408,
24 49-409, 49-414, 49-416, 49-418 and 49-418D, Idaho Code. For special plates
25 issued pursuant to sections 49-406 and 49-406A, Idaho Code, there shall be an
26 initial program fee of twenty-five dollars ($25.00) but there shall be no
27 annual renewal fee. For special plates issued pursuant to sections 49-416A,
28 49-416B, 49-416C, 49-417, 49-417A, 49-417B, 49-417C, 49-418A, 49-418B,
29 49-418C, 49-418E, 49-419, 49-419A, 49-419B, 49-419C, 49-419D, 49-420, 49-420A,
30 49-420B, 49-420C, 49-420D, 49-420E and 49-420G, Idaho Code, there shall be an
31 initial program fee of thirty-five dollars ($35.00) and an annual program fee
32 of twenty-five dollars ($25.00). The fees contained in this subsection shall
33 be applicable to all new special plate programs. The initial program fee and
34 the annual program fee shall be deposited in the state highway account and
35 shall be used to fund the cost of administration of special license plate pro-
36 grams, unless otherwise specified by law.
37 SECTION 2. That Chapter 4, Title 49, Idaho Code, be, and the same is
38 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
39 ignated as Section 49-418E, Idaho Code, and to read as follows:
40 49-418E. IDAHO ELKS REHABILITATION HOSPITAL PLATES. (1) On and after Jan-
41 uary 1, 2007, any person who is the owner of a vehicle registered under the
42 provisions of section 49-402, Idaho Code, or registered under any other sec-
43 tion of law for which the purchase of special plates is allowed, may apply for
44 and, upon department approval, receive special Idaho elks rehabilitation hos-
45 pital license plates, which shall be referred to as "Idaho elks" plates, in
46 lieu of regular license plates. The provisions of this section shall not apply
47 to any vehicle with a registered maximum gross weight over twenty-six thousand
48 (26,000) pounds. Availability of Idaho elks license plates for other vehicles
49 shall be subject to the rules, policies and procedures of the department.
50 (2) In addition to the regular registration fee required in chapter 4,
51 title 49, Idaho Code, the applicant shall be charged a fee of thirty-five dol-
52 lars ($35.00) for the initial issuance of plates, and twenty-five dollars
53 ($25.00) upon each succeeding annual registration. Ten dollars ($10.00) of the

1 initial fee and ten dollars ($10.00) of the renewal fee shall be deposited in
2 the state highway account and shall be used to fund the cost of administration
3 of this special license plate program. Twenty-five dollars ($25.00) of each
4 initial fee and fifteen dollars ($15.00) of each renewal fee shall be trans-
5 ferred by the state treasurer for deposit to the Idaho elks rehabilitation
6 hospital located in Boise, Idaho, and shall be used by the hospital in provid-
7 ing rehabilitative programs and services in specialized areas including pedi-
8 atrics, brain injury, stroke, hearing and balance, the wound clinic, and phys-
9 ical, speech and occupational therapies.
10 (3) Whenever title or interest in a vehicle registered under the provi-
11 sions of this section is transferred or assigned, the owner may transfer the
12 special plates to another vehicle upon payment of the required transfer fees.
13 The owner may only display the plates on another vehicle upon receipt of the
14 new registration from the department.
15 (4) The Idaho elks license plate shall be of a color and design in accor-
16 dance with the provisions of section 49-402C, Idaho Code. The design and any
17 slogan on the plate shall be acceptable to the governing board of the Idaho
18 elks rehabilitation hospital and shall be approved by the Idaho transportation
19 department utilizing a numbering system as determined by the department. Ini-
20 tial costs of the plate program, including costs of plate design, shall be
21 paid by the Idaho elks rehabilitation hospital.
22 (5) Sample Idaho elks license plates may be purchased for a fee of thirty
23 dollars ($30.00), ten dollars ($10.00) of which shall be deposited in the
24 state highway account and twenty dollars ($20.00) of which shall be trans-
25 ferred to the Idaho elks rehabilitation hospital located in Boise, Idaho, and
26 shall be used by the hospital in providing rehabilitative programs and ser-
27 vices in specialized areas including pediatrics, brain injury, stroke, hearing
28 and balance, the wound clinic, and physical, speech and occupational thera-
29 pies.
30 SECTION 3. This act shall be in full force and effect on and after Janu-
31 ary 1, 2007.

Relating to special Idaho Elks Rehabilitation Hospital License
Plate, amending Section 49-418A, Idaho Code, to expand the special
motor vehicle license plate program to include the Idaho Elks
Rehabilitation Hospital License Plate.
FISCAL NOTE
There will be no fiscal impact to the State of Idaho. The cost
of design and printing will be paid by a private donor.
