if revenues do not meet the previous year's revenues; and to provide that
cities shall not receive less money than they received in the previous

Highway Distribution Account meet or exceed the previous fiscal year's
revenues; and to provide for distribution of a surplus.

1 AN ACT
2 RELATING TO APPORTIONMENT OF FUNDS FROM THE HIGHWAY DISTRIBUTION ACCOUNT TO
3 LOCAL UNITS OF GOVERNMENT; AMENDING SECTION 40-709, IDAHO CODE, TO PROVIDE
4 DISTRIBUTION IF REVENUES DO NOT MEET THE PREVIOUS YEAR'S REVENUES AND TO
5 PROVIDE THAT CITIES SHALL NOT RECEIVE LESS MONEY THAN THEY RECEIVED IN THE
6 PREVIOUS FISCAL YEAR FROM THE HIGHWAY DISTRIBUTION ACCOUNT IF REVENUES IN
7 THE HIGHWAY DISTRIBUTION ACCOUNT MEET OR EXCEED THE PREVIOUS FISCAL YEAR'S
8 REVENUES AND TO PROVIDE FOR SURPLUS DISTRIBUTION.
9 Be It Enacted by the Legislature of the State of Idaho:
10 SECTION 1. That Section 40-709, Idaho Code, be, and the same is hereby
11 amended to read as follows:
12 40-709. APPORTIONMENT OF FUNDS FROM HIGHWAY DISTRIBUTION ACCOUNT TO LOCAL
13 UNITS OF GOVERNMENT. Commencing July 1, 1999, and each fiscal year thereafter,
14 from the moneys appropriated from the highway distribution account to local
15 units of government, three hundred twenty-six thousandths of one percent
16 (0.326%) is appropriated to the local highway technical assistance council,
17 and the balance of the appropriation shall be distributed as follows:
18 (1) (a) Thirty percent (30%) shall be apportioned among incorporated and
19 specially chartered cities, in the same proportion as the population of
20 the incorporated or specially chartered city bears to the total population
21 of all the incorporated or specially chartered cities as shown by the last
22 regular or special federal census.
23 (b) If revenues do not meet the previous fiscal year's revenues, the
24 amount distributed shall be distributed as provided in subsection (1)(a)
25 of this section. If revenues meet or exceed the previous fiscal year's
26 revenues, the amount distributed individually to each of the cities shall
27 be no less than the appropriated revenue they received the previous fiscal
28 year. Once the base amount has been preserved, the funds that meet or
29 exceed the previous fiscal year's revenues will be distributed as provided
30 in this subsection.
31 (2) The remainder shall be apportioned:
32 (a) Ten percent (10%) shall be divided equally among all counties of the
33 state.
34 (b) Forty-five percent (45%) shall be divided among the counties of the
35 state in the proportion that the amount collected from motor vehicle reg-
36 istrations in each county during the last calendar year bears to the total
37 amount of those collections in all counties in the state.
38 (c) Forty-five percent (45%) shall be divided among the counties of the
39 state in the proportion that the number of miles of improved highways in
40 the county highway system of each county bears to the total number of
41 miles of improved highways in the county highway systems of all counties
42 in the state. The director is directed to certify to the state controller,
43 on or before January 1 of each year, the number of miles of improved high-

1 ways in each county.
2 (3) Moneys paid to counties with highway districts shall be further dis-
3 tributed by the state as follows:
4 (a) Ten percent (10%) shall be divided equally among the county, if the
5 county maintains any highways, and the highway districts;
6 (b) Forty-five percent (45%) shall be divided among the county, if the
7 county maintains any highways, and the highway districts of the county in
8 the proportion that the amount collected from motor vehicle registrations
9 in each area designated during the last calendar year bears to the total
10 amount of those collections in the entire county;
11 (c) Forty-five percent (45%) shall be divided among the county, if the
12 county maintains any highways, and the highway districts in the proportion
13 that the number of miles of improved highways in the county and the high-
14 way districts bear to the total number of miles of improved highways in
15 the entire county highway system.
16 (4) The state controller shall ascertain the sums set for the apportion-
17 ment and remit to the local governments their share of the amount computed.
18 The apportionment hereby made shall be remitted to the local governments not
19 later than January 25, April 25, July 25, and October 25 of each year.
20 (5) Moneys paid to incorporated or specially chartered cities shall be
21 expended by the governing bodies of those cities solely in the construction
22 and maintenance of highways within their corporate limits and to meet the
23 interest and sinking fund requirements for the current year on any unpaid
24 bonds issued by those cities for highway and bridge purposes, or refunding
25 bonds issued to take up those bonds.
26 (6) Each highway district receiving an apportionment from the highway
27 distribution account shall apportion those funds as follows: To the interest
28 and sinking fund of the district, an amount as may be necessary to meet the
29 interest and sinking fund requirements for that year on any unpaid bonds
30 issued by that district, and any balance of those funds shall be used for
31 highway and bridge maintenance and construction. Each district may expend all
32 or any portion of the balance of those funds in the construction and mainte-
33 nance of state highways within the district.
34 (7) No part of highway funds or any apportionment from it shall ever be
35 used for any purposes other than those provided in this section, except as
36 specifically otherwise provided. At the end of any fiscal year an unexpended
37 balance of highway funds shall be carried forward and retained and subse-
38 quently applied to the maintenance and construction of highways or the payment
39 of bond interest and principal and sinking fund requirements.

This legislation would assure that when revenues appropriated
from the Highway Distribution account which goes to cities, meets
or exceeds the previous fiscal year's revenue, that base amount
will be preserved and the excess will be distributed through the
normal formula.
FISCAL NOTE
No fiscal impact to the general fund, but will impact
distribution of funds to the cities.
