  1                                        AN ACT
  2    RELATING TO JUDGES' RETIREMENT AND COMPENSATION; AMENDING CHAPTER 20, TITLE 1,
  3        IDAHO CODE, BY THE ADDITION OF A NEW SECTION 1-2012, IDAHO  CODE,  TO  AU-
  4        THORIZE  THE  SUPREME COURT TO ADOPT, AMEND AND RESCIND RULES AND ADMINIS-
  5        TRATIVE POLICIES.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Chapter 20, Title 1, Idaho Code,  be,  and  the  same  is
  8    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
  9    ignated as Section 1-2012, Idaho Code, and to read as follows:
                                                                        
 10        1-2012.  RULES AND ADMINISTRATIVE POLICIES. Subject to  the  other  provi-
 11    sions of this chapter, the supreme court shall have the power and authority to
 12    adopt, amend and rescind such rules and administrative policies as may be nec-
 13    essary for the proper administration of this chapter.

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE

This bill addresses the authority of the Supreme Court to adopt, amend
or rescind rules for the administration of the Idaho Judges 
Retirement Fund. It would add a statutory provision conferring such
authority on the court; this would be similar to Idaho Code Section
59-1314(1), which gives the Retirement Board rule-making authority
with regard to the Public Employee Retirement Fund. Such rule-making
authority would pertain only to administrative matters and would not
extend to the level of retirement benefits, which would remain a
matter to be determined by the Legislature by statute.

This bill would have no impact on the general fund.
