  1                                        AN ACT
  2    RELATING TO PUBLIC SCHOOLS; AMENDING CHAPTER 16, TITLE 33, IDAHO CODE, BY  THE
  3        ADDITION OF A NEW SECTION 33-1618, IDAHO CODE, TO PROVIDE FOR AN EXCEPTION
  4        TO  PARTICIPATION IN THE DIRECT WRITING AND THE DIRECT MATHEMATICS ASSESS-
  5        MENTS.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Chapter 16, Title 33, Idaho Code, be,  and  the  same  is
  8    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
  9    ignated as Section 33-1618, Idaho Code, and to read as follows:
                                                                        
 10        33-1618.  ASSESSMENT EXCEPTION. A student who has not  been  enrolled  for
 11    two  (2)  full school years in an elementary or secondary school in the United
 12    States and who scores less than a level four (4) on the state assessment  used
 13    to determine English language proficiency may be excluded from requirements to
 14    participate  in Idaho's direct writing assessment and in Idaho's direct mathe-
 15    matics assessment if the parent or guardian of such student and the  student's
 16    teacher agree that such an exclusion is educationally appropriate for the stu-
 17    dent.

                       STATEMENT OF PURPOSE

This legislation would allow for students with limited English
proficiency who have been enrolled in Idaho's public schools for
less than two years to be excluded from the requirements to
participate in Idaho's direct writing and direct mathematics
assessments on the condition that the student scores less than a
level four on the state assessment used to determine English
language proficiency and the parent or guardian of such students
and the students' teachers agree that such an exclusion would be
educationally appropriate for the student.
