a fee from owners or developers of a subdivision by a county, with the
moneys to be utilized for training conducted by Idaho higher educational
institutions for planner certification; to provide that training may
include instruction in environmental land use issues, zoning and land use
principles, landscape design, public administration and economic and
financial responsibility in a land use context; to create the county

  2    RELATING TO LAND USE PLANNING; AMENDING CHAPTER 8, TITLE 31,  IDAHO  CODE,  BY
  3        THE  ADDITION OF A NEW SECTION 31-831, IDAHO CODE, TO ALLOW THE COLLECTION
  4        OF A FEE FROM OWNERS OR DEVELOPERS OF A SUBDIVISION BY A COUNTY, WITH  THE
  5        MONEYS  TO  BE UTILIZED FOR TRAINING CONDUCTED BY IDAHO HIGHER EDUCATIONAL
  6        INSTITUTIONS FOR PLANNER CERTIFICATION, TO PROVIDE THAT THE  TRAINING  MAY
  7        INCLUDE  INSTRUCTION IN ENVIRONMENTAL LAND USE ISSUES, ZONING AND LAND USE
  8        PRINCIPLES, LANDSCAPE  DESIGN,  PUBLIC  ADMINISTRATION  AND  ECONOMIC  AND
  9        FINANCIAL RESPONSIBILITY IN A LAND USE CONTEXT, TO CREATE THE COUNTY PLAN-
 10        NING EDUCATION FUND AND TO PROVIDE FOR EXPENDITURE OF MONEYS IN THE FUND.
                                                                        
 11    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 12        SECTION  1.  That  Chapter  8,  Title  31, Idaho Code, be, and the same is
 13    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 14    ignated as Section 31-831, Idaho Code, and to read as follows:
                                                                        
 15        31-831.  FEES  FOR  PLATS.  (1)  Pursuant to resolution, a board of county
 16    commissioners may impose and collect from the owner or developer of a subdivi-
 17    sion as defined in section 50-1301, Idaho Code, a user fee not  in  excess  of
 18    one  hundred  dollars  ($100)  per  lot on plats under the jurisdiction of the
 19    county, including final plats, corrected final plats and condominium amendment
 20    plats, to be used for the development, sponsorship, promotion and  administra-
 21    tion  of  a  planning  education curriculum to be offered by an institution of
 22    higher education located in the state, which planning education curriculum  is
 23    deemed  a  public  benefit. It is the intent of this section that the training
 24    offered by Idaho higher educational institutions be  directed  toward  planner
 25    certification  and  may  include instruction in environmental land use issues,
 26    zoning and land use principles, landscape design,  public  administration  and
 27    economic and financial responsibility in a land use context.
 28        (2)  The fees collected pursuant to this section shall be deposited in the
 29    county planning education fund which is hereby created in the county treasury.
 30    Moneys  in  the  fund may be used to contract with an Idaho higher educational
 31    institution to provide courses and instruction to county employees in the sub-
 32    ject matter enumerated in subsection (1) of this  section.  Any  county  funds
 33    expended  pursuant  to  this  section  shall be subject to audit and any Idaho
 34    institution of higher learning shall agree to such provision before  receiving
 35    funds pursuant to this section.

                           STATEMENT OF PURPOSE

                                RS 16209C1 

     To add a statute authorizing a board of county commissioners
to impose and collect a user fee from the owner or developer
creating a subdivision as defined in Idaho Code, 
& 50-1301(15) per lot on plats under the jurisdiction of the
county.  The statute prescribes that the said fees are to be
dedicated to the development, sponsorship, promotion and
administration of a Planning Education Curriculum at a local
institution of higher learning for the public benefit.  The
statute further prescribes the manner of collecting the fees and
the procedure for remitting the fees to the institution of choice
of the commissioners.
