  1                                        AN ACT
  2    APPROPRIATING MONEYS TO THE IDAHO STATE LOTTERY FOR FISCAL YEAR 2007; LIMITING
  3        THE NUMBER  OF  FULL-TIME  EQUIVALENT  POSITIONS;  EXPRESSING  LEGISLATIVE
  4        INTENT  TO CLARIFY THE SCOPE OF THE APPROPRIATION; AND DIRECTING THE ALLO-
  5        CATION OF SALARY SAVINGS.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  There is hereby appropriated to the Idaho State Lottery in the
  8    Department of Self-Governing Agencies the following amounts to be expended for
  9    administrative costs according to the  designated  expense  classes  from  the
 10    listed fund for the period July 1, 2006, through June 30, 2007:

 14    Capital Outlay                                                         159,000

 18        SECTION  2.  In  accordance  with  Section  67-3519, Idaho Code, the Idaho
 19    State Lottery is authorized no more than forty-eight (48) full-time equivalent
 20    positions at any point during the period July 1, 2006, through June 30,  2007,
 21    unless   specifically   authorized   by   the  Governor.  The  Joint  Finance-
 22    Appropriations Committee will be notified promptly of any increased  positions
 23    so authorized.
                                                                        
 24        SECTION 3.  It is legislative intent that amounts necessary to pay prizes,
 25    retailer  commissions, advertising and promotional costs shall be continuously
 26    appropriated to the Idaho  State  Lottery  under  the  provisions  of  Section
 27    67-7428, Idaho Code.
                                                                        
 28        SECTION  4.  The  State  Lottery Commission is hereby directed to allocate
 29    salary savings, based on performance, to provide  for  employee  salary  needs
 30    before  other  operational budget priorities are considered. Where applicable,
 31    employees whose salaries are below the midpoint of their pay grade or  occupa-
 32    tional groups with significant turnover rates shall be considered first in the
 33    order of salary savings distributions.
