1 AN ACT
2 APPROPRIATING MONEYS FROM THE PERMANENT BUILDING FUND TO THE DIVISION OF PUB-
3 LIC WORKS FOR THE VARIOUS PURPOSES SPECIFIED; EXPRESSING LEGISLATIVE
4 INTENT CONCERNING THE USE OF MONEYS APPROPRIATED IN THIS ACT; EXEMPTING
5 THE APPROPRIATIONS FROM THE PROVISIONS OF CHAPTER 36, TITLE 67, IDAHO
6 CODE, AND FROM THE PROVISIONS OF SECTION 67-3516, IDAHO CODE; AUTHORIZING
7 THE USE OF TAX ANTICIPATION NOTES; DIRECTING THE TRANSFER OF MONEYS FROM
8 THE GENERAL FUND TO THE PERMANENT BUILDING FUND FOR FISCAL YEAR 2007; PRO-
9 VIDING FOR THE TRANSFER OF MONEYS FROM THE MISCELLANEOUS REVENUE FUND IN
10 THE DIVISION OF VETERANS SERVICES TO THE PERMANENT BUILDING FUND FOR FIS-
11 CAL YEAR 2006; AND DECLARING AN EMERGENCY FOR SECTION 6 OF THIS ACT.
12 Be It Enacted by the Legislature of the State of Idaho:
13 SECTION 1. There is hereby appropriated from the Permanent Building Fund
14 to the Division of Public Works the following amounts, or so much thereof as
15 in each case may be necessary, for the purpose of paying the cost of any land,
16 building, equipment, or the rebuilding, renovation or repair, of buildings,
17 installations, facilities or structures at the places, institutions and agen-
18 cies, or their successors, including those listed in this section. The Perma-
19 nent Building Fund Advisory Council is hereby authorized and directed to
20 anticipate revenues accruing to the Permanent Building Fund for the purpose of
21 undertaking the construction, renovation, repair and acquisitions herein
22 authorized, without delay, and to determine the priority of construction pur-
23 suant to which the work hereunder will be undertaken.

1 SECTION 2. It is legislative intent that the moneys appropriated in this
2 act may be made available for matching any allocation of moneys now in exis-
3 tence or hereafter made available by agencies of the United States and/or pri-
4 vate donations; and it is further the express intention of the Legislature to
5 authorize the Division of Public Works to expend, for the purpose of paying
6 the cost of any land, building, equipment or the rebuilding, renovation or
7 repair of buildings, moneys appropriated for public works to various agencies
8 as part of the respective agency operating budgets; provided the express
9 approval by the Permanent Building Fund Advisory Council is granted to make
10 application for such moneys in each instance.
11 SECTION 3. All appropriations made herein shall be exempt from the provi-
12 sions of Chapter 36, Title 67, and Section 67-3516, Idaho Code, but shall be
13 available for expenditure only after allotment in accordance with the other
14 provisions of Chapter 35, Title 67, Idaho Code, and all appropriations made
15 hereunder shall be subject to the provisions of Section 67-5711, Idaho Code,
16 except as otherwise provided herein.
17 SECTION 4. The State Treasurer is hereby authorized and directed to
18 anticipate the revenues in the Permanent Building Fund by the issuance of tax
19 anticipation notes in accordance with authority conferred in Sections 63-3201
20 through 63-3204, Idaho Code, and in accordance with the procedures and subject
21 to the limitations provided in those sections, in the same manner as though
22 the revenues in the General Fund were being anticipated.
23 SECTION 5. The State Controller is hereby directed to transfer on July 1,
24 2006, or as soon thereafter as is practicable, $21,000,000 from the state Gen-
25 eral Fund to the Permanent Building Fund.
26 SECTION 6. On or before June 30, 2006, the State Controller, at the
27 request of the Director of the Division of Veterans Services, shall transfer
28 $302,000 from the Miscellaneous Revenue Fund in the Division of Veterans Ser-
29 vices to the Permanent Building Fund. These funds shall be used to construct
30 an enclosed parking garage at the Pocatello Veterans Home after July 1, 2006.
31 SECTION 7. An emergency existing therefor, which emergency is hereby
32 declared to exist, Section 6 of this act shall be in full force and effect on
33 and after passage and approval.

This is the fiscal year 2007 appropriation bill for the Permanent Building fund in the amount of $52,428,300. This budget is funded entirely with dedicated funds. The bill provides $25,101,000 for state-wide alteration and repair projects which includes $9,000,000 for higher education alteration and repair priorities. This bill also provides funding for six additional capital projects.
