  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO
  3        APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF THE CURRENT  MEN-
  4        TAL  HEALTH AND SUBSTANCE ABUSE TREATMENT DELIVERY SYSTEMS IN IDAHO AND TO
  5        REVIEW ALTERNATIVE WAYS TO PROVIDE THESE SERVICES.
                                                                        
  6    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  7        WHEREAS, the Department of Health and Welfare has grown too  large  as  an
  8    agency  to effectively manage substance abuse treatment and mental health ser-
  9    vices for children and adults; and
 10        WHEREAS,  the district and magistrate courts, the Department of Correction
 11    and the Department of Juvenile Corrections and counties  are  being  adversely
 12    affected  by our inability to address the needs of those with mental health or
 13    substance abuse issues and those who are dual-diagnosed; and
 14        WHEREAS, the staggering cost of mental health and substance  abuse  treat-
 15    ment  systems  without  accountability  measures  in either should not be sus-
 16    tained; and
 17        WHEREAS, the Legislature has struggled to find methods to provide guidance
 18    for substance abuse and mental health treatment design, delivery and  account-
 19    ability;
 20        WHEREAS,  mental health services funded through Medicaid have been subject
 21    to some scrutiny through the pilot credentialing authorized by the Legislature
 22    in 2005 in the Department of Health and Welfare's appropriation; and
 23        WHEREAS, there is a policy question as to whether substance abuse services
 24    and adult and children's mental health services ought to be removed  from  the
 25    Department  of  Health  and  Welfare  and  be  combined into a new stand alone
 26    agency.
 27        NOW, THEREFORE, BE IT RESOLVED by the members of the Second  Regular  Ses-
 28    sion  of  the Fifty-eighth Idaho Legislature, the House of Representatives and
 29    the Senate concurring therein, that the Legislative Council is  authorized  to
 30    appoint  a  committee  to undertake and complete a study of the current mental
 31    health and substance abuse treatment delivery systems in Idaho and  to  review
 32    alternative  ways  to  provide these services and make recommendations for any
 33    changes the committee would see as appropriate, with specific  attention  paid
 34    to a system that meets the needs of, and provides accountability to, Idahoans.
 35    The  Legislative Council shall determine the number of legislators and member-
 36    ship from each house appointed to the committee and shall authorize  the  com-
 37    mittee  to  receive  input, advice and assistance from interested and affected
 38    parties who are not members of the Legislature.
 39        BE IT FURTHER RESOLVED that nonlegislative members of the committee may be
 40    appointed by the cochairs of the committee who are appointed by  the  Legisla-
 41    tive  Council.  Nonlegislative  members of the advisory committee shall not be
 42    reimbursed from legislative funds for per diem, mileage or other expenses  and
 43    shall  not have voting privileges regarding the committee's recommendations or
 44    proposed legislation.

  1        BE IT FURTHER RESOLVED that the committee shall report its findings,  rec-
  2    ommendations and proposed legislation, if any, to the First Regular Session of
  3    the Fifty-ninth Idaho Legislature.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                            RS 16238

This resolution authorizes the creation of an interim committee,
to be created by the Legislative Council, for the purpose of
evaluating the merits of removing the programs of substance
abuse, adult and children's mental health from the Department of
Health and Welfare, and combining them into a new agency.  The
purpose of such a move would be to improve treatment to those in
need of services and provide more accountability for the quality
and cost of those services.  It would allow for a thorough study
of this issue by all relevant parties. The committee would be
charged with making recommendations to the next regular session
of the Idaho Legislature. 



                           FISCAL NOTE

The cost of the Committee would be expected to not exceed
$10,000. It would be paid for from the Legislative Account.
