HOUSE JOINT MEMORIAL NO. 13

2 TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CONGRESS
3 ASSEMBLED, AND TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF
4 IDAHO IN THE CONGRESS OF THE UNITED STATES.
5 We, your Memorialists, the House of Representatives and the Senate of the
6 State of Idaho assembled in the Second Regular Session of the Fifty-eighth
7 Idaho Legislature, do hereby respectfully represent that:
8 WHEREAS, the goal of the No Child Left Behind Act (NCLB), moving all stu-
9 dents to proficiency in reading, language and mathematics by 2014, is laud-
10 able; and
11 WHEREAS, that goal can best be achieved by providing the Idaho kindergar-
12 ten through twelfth grade public education system the flexibility to capital-
13 ize on Idaho's unique resources and population; and
14 WHEREAS, Idaho has been a national leader in school improvement reform as
15 exemplified by the passage of the Idaho Reading Initiative, the creation of
16 academic standards, the alignment of Idaho public school curricula, and the
17 creation of the Idaho Standards Achievement Test (ISAT); and
18 WHEREAS, Idaho applauds and supports the implementation and expansion of
19 Secretary Spellings' flexibility framework for new NCLB policy announced April
20 7, 2005, including the implementation of pilot programs to study use of growth
21 models in calculating Adequate Yearly Progress (AYP); and
22 WHEREAS, education stakeholders in Idaho are committed to providing the
23 best public education possible for our children; and
24 WHEREAS, providing a quality education requires that certain aspects of
25 NCLB be further enhanced.
26 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses-
27 sion of the Fifty-eighth Idaho Legislature, the House of Representatives and
28 the Senate concurring therein, that we urge the Congress to support federal
29 legislation that will address the following:
30 (1) Correcting difficulties in the calculation of AYP;
31 (2) Providing states the flexibility to effectively and efficiently use
32 resources by targeting sanctions to students who actually need assistance;
33 (3) Providing states local control over their education systems by allow-
34 ing waivers to accommodate high-quality state accountability systems, includ-
35 ing the use of measures of progress;
36 (4) Providing states more individualized measures of success in calculat-
37 ing AYP for students with disabilities and limited English proficient stu-
38 dents; and
39 (5) Placing funding triggers in the federal program so that the most
40 costly sanctions are not implemented in any year in which Congress does not
41 provide adequate funding to states.
42 BE IT FURTHER RESOLVED that the Chief Clerk of the House of Representa-
43 tives be, and she is hereby authorized and directed to forward a copy of this
44 Memorial to the President of the Senate and the Speaker of the House of Repre-

1 sentatives of Congress, and the congressional delegation representing the
2 State of Idaho in the Congress of the United States.

STATEMENT OF PURPOSE
RS 15771
The purpose of this memorial is to request Congress to set
different testing standards and annual yearly progress
requirements under the No Child Left Behind program for students
of limited English proficiency or students enrolled in special
education.

There is no fiscal impact.
