  1                                   A JOINT MEMORIAL
  2    TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED  STATES  IN  CONGRESS
  3        ASSEMBLED,  AND  TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF
  4        IDAHO IN THE CONGRESS OF THE UNITED STATES.
                                                                        
  5        We, your Memorialists, the House of Representatives and the Senate of  the
  6    State  of  Idaho  assembled  in the Second Regular Session of the Fifty-eighth
  7    Idaho Legislature, do hereby respectfully represent that:
                                                                        
  8        WHEREAS, the judicial branch is one of three separate branches of  govern-
  9    ment  and with respect to the judiciary at the federal level, its powers arise
 10    from the Constitution of the United States and the consent  of  the  governed;
 11    and
 12        WHEREAS,  the  United  States  Supreme Court and lower federal courts, and
 13    most notoriously, the U.S. Court  of  Appeals  for  the  Ninth  Circuit,  have
 14    repeatedly  ruled  inconsistently  with  the intent of the authors of the U.S.
 15    Constitution and in derogation of the founding traditions  and  principles  of
 16    America; and
 17        WHEREAS,  federal  judges  and members of Congress swear an oath to uphold
 18    the Constitution of the United States; and
 19        WHEREAS, Congress has a constitutional duty to require that these oaths be
 20    honored by federal judges.
 21        NOW, THEREFORE, BE IT RESOLVED by the members of the Second  Regular  Ses-
 22    sion  of  the Fifty-eighth Idaho Legislature, the House of Representatives and
 23    the Senate concurring therein, that we urgently request the congressional del-
 24    egation representing the state of Idaho in the Congress of the  United  States
 25    to end the era of judicial activism and to reestablish judicial accountability
 26    by  supporting  the  passage of and becoming cosponsors on Senate Bill 520, to
 27    curb the jurisdictions of federal courts which have  shown  contempt  for  the
 28    Constitution of the United States.
 29        BE  IT  FURTHER  RESOLVED that the Chief Clerk of the House of Representa-
 30    tives be, and she is hereby authorized and directed to forward a copy of  this
 31    Memorial to the President of the Senate and the Speaker of the House of Repre-
 32    sentatives  of  Congress,  and  the  congressional delegation representing the
 33    State of Idaho in the Congress of the United States.

                       STATEMENT OF PURPOSE

                             RS 15911

This memorial offers the support of the Idaho Legislature to the
United States Congress in their efforts to ask for greater
accountability by federal judges in their decisions to uphold the
United States Constitution and the original intent set forth by
the Founding Fathers.



                           FISCAL NOTE

There is no fiscal impact to the general fund.
