  1                                        AN ACT
  2    RELATING TO COURTS; REPEALING SECTION 1-1612, IDAHO CODE, REQUIRING PERSONS TO
  3        APPEAR AT APPOINTED PLACES.
                                                                        
  4    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  5        SECTION 1.  That Section 1-1612, Idaho Code, be, and the  same  is  hereby
  6    repealed.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE
                             RS 15473

  This bill is one of a series of bills that the Supreme Court
has recommended in its annual report to the Governor concerning
defects or omissions in the laws, as required under article V,
section 25 of the Idaho Constitution.  It would repeal an obsolete
statute.  Idaho Code  1-1612 provides, "When the court is held at
a place appointed as provided in the last section, every person
held to appear at the court must appear at the place so appointed." 
The "last section" referred to was Idaho Code  1-1611, which was
repealed in 1975; it dealt with the closing or relocating of courts
in emergencies, a subject now addressed by Rule 48 of the Idaho
Court Administrative Rules.  Therefore, Idaho Code  1-1612 no
longer has any application.


                           FISCAL NOTE

  This bill would have no impact on the general fund.
