]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE SENATE SENATE BILL NO. 1288 BY SCHROEDER 1 AN ACT 2 RELATING TO NOTICE OF STATE AND LOCAL GOVERNMENT MEETINGS; AMENDING SECTION 3 67-2343, IDAHO CODE, TO PROVIDE THAT ALL MEETING NOTICES INCLUDING TIME 4 OR PLACE CHANGES SHALL BE POSTED ON THE OUTSIDE OF THE ORIGINAL MEETING 5 PLACE IN A CONSPICUOUS PLACE. 6 Be It Enacted by the Legislature of the State of Idaho: 7 8 SECTION 1. That Section 67-2343, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 67-2343. NOTICE OF MEETINGS. (1) Regular meetings. No less than a five 11 (5) calendar day meeting notice shall be given unless otherwise provided by 12 statute. Provided however, that any public agency that holds meetings at regu- 13 lar intervals of at least once per calendar month scheduled in advance over 14 the course of the year may satisfy this meeting notice by giving meeting 15 notices at least once each year of its regular meeting schedule. A forty-eight 16 (48) hour agenda notice shall be required in advance of each regular meeting, 17 however, additional agenda items may be added after completion of the agenda 18 up to and including the hour of the meeting, provided that a good faith effort 19 is made to include in the notice all agenda items known at the time to be 20 probable items of discussion. The notice requirement for meetings and agendas 21 shall be satisfied by posting such notices and agendas in a prominent place at 22 the principal office of the public agency, or if no such office exists, at the 23 building where the meeting is to be held. 24 (2) Special meetings. No special meeting shall be held without at least a 25 twenty-four (24) hour meeting and agenda notice, unless an emergency exists. 26 An emergency is a situation involving injury or damage to persons or property, 27 or immediate financial loss, or the likelihood of such injury, damage or loss, 28 when the notice requirements of this section would make such notice impracti- 29 cable, or increase the likelihood or severity of such injury, damage or loss, 30 and the reason for the emergency is stated at the outset of the meeting. The 31 notice required under this section shall include at a minimum the meeting 32 date, time, place and name of the public agency calling for the meeting. The 33 secretary or other designee of each public agency shall maintain a list of the 34 news media requesting notification of meetings and shall make a good faith 35 effort to provide advance notification to them of the time and place of each 36 meeting. 37 (3) Executive sessions. If an executive session only will be held, a 38 twenty-four (24) hour meeting and agenda notice shall be given according to 39 the notice provisions stated in subsection (2) of this section and shall state 40 the reason and the specific provision of law authorizing the executive ses- 41 sion. 42 (4) Meeting notices placement. All meeting notices including time or 43 place changes shall be posted on the outside of the original meeting place in 44 a conspicuous place.
