]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE SENATE SENATE BILL NO. 1334 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO PAID FIREMEN; AMENDING CHAPTER 211, LAWS OF 1990, BY THE ADDITION 3 OF A NEW SECTION 8, CHAPTER 211, LAWS OF 1990, TO SET FORTH APPLICATION OF 4 SPECIFIED PROVISIONS; AMENDING SECTION 8, CHAPTER 211, LAWS OF 1990, TO 5 REDESIGNATE THE SECTION; DECLARING AN EMERGENCY AND PROVIDING RETROACTIVE 6 APPLICATION. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Chapter 211, Laws of 1990, be, and the same is hereby 9 amended by the addition thereto of a NEW SECTION, to be known and designated 10 as Section 8, Chapter 211, Laws of 1990, and to read as follows: 11 SECTION 8. The provisions of Section 6 of this act shall be deemed to 12 apply to all paid firemen hired on or after July 1, 1978, and before October 13 1, 1980, who are incapacitated in the performance of duty and whose retirement 14 date was prior to April 3, 1990, provided however, that no interest shall 15 accrue on any benefit payments due such firemen pursuant to this Section 8, 16 and provided further that no such benefit payments made pursuant to this Sec- 17 tion 8, shall be considered underpayments under Section 59-1327(6), Idaho 18 Code. 19 SECTION 2. That Section 8, Chapter 211, Laws of 1990, be, and the same is 20 hereby amended to read as follows: 21 SECTION89. An emergency existing therefor, which emergency is hereby 22 declared to exist, this act shall be in full force and effect on and after its 23 passage and approval. 24 SECTION 3. An emergency existing therefor, which emergency is hereby 25 declared to exist, this act shall be in full force and effect on and after its 26 passage and approval, and retroactively to April 3, 1990.
STATEMENT OF PURPOSE RS 15753 By virtue of Chapter 211, Laws of 1990, the Legislature amended various sections of Title 72, Chapter 14, Idaho Code, the Firemen s Retirement Fund (FRF), to delete reference to the provisions relating to firemen hired between July 1, 1978 and October 1, 1980, the effective date of the statutory "merger" of the FRF into the Public Employees Retirement System of Idaho (PERSI). As set forth in the Statement of Purpose of Senate Bill 1525, there were approximately 41 paid firemen hired during this 27 month period who were entitled to significantly less retirement benefits than all the other approximately 340 paid fireman members of the FRF, even though by virtue of other FRF statutes, the employee and employer contribution rates of the 1978-1980 members were identical to the other FRF members. The purpose of the 1990 legislation was to assure equitable pension benefit treatment to all paid fireman members of the FRF whose employer and employee contribution rates were identical. This bill will amend Chapter 211, Laws of 1990, to clarify that the provisions of the in-service disability provisions of that act also shall be deemed to apply to all paid firemen hired between July 1, 1978, and October 1, 1980, who were incapacitated in the performance of duty and whose retirement date was prior to the April 3, 1990, effective date of that act, provided that any back benefits payable shall not include interest thereon, and shall not be considered underpayments under Section 59-1327(6), currently Section 59-1305(6) FISCAL IMPACT This bill would have no impact on the General Fund. There will be approximately $70,000 in past liability costs to the Firefighters Retirement Fund and approximately $105,000 in future liability costs. The actuary estimates this total increase of about .065% of the liabilities would not affect the funding ratio, amortization period, or contribution rates for the Firefighters Retirement Fund.
