1 AN ACT
2 RELATING TO JUDICIAL DISTRICTS; AMENDING SECTION 1-802, IDAHO CODE, TO
3 INCREASE THE NUMBER OF DISTRICT JUDGES AND RESIDENT CHAMBERS IN THE FIRST
4 DISTRICT; AND AMENDING SECTION 1-804, IDAHO CODE, TO INCREASE THE NUMBER
5 OF DISTRICT JUDGES AND RESIDENT CHAMBERS IN THE THIRD DISTRICT.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That Section 1-802, Idaho Code, be, and the same is hereby
8 amended to read as follows:
9 1-802. FIRST DISTRICT -- NUMBER OF JUDGES -- RESIDENT CHAMBERS. (1) The
10 first judicial district shall consist of the counties of Boundary, Bonner,
11 Kootenai, Shoshone and Benewah.
12 (2) The first judicial district shall have five six (56) district judges.
13 (3) Resident chambers of the district judges of the first judicial dis-
14 trict shall be established as follows:
15 (a) One (1) resident chambers shall be established in Bonner County;
16 (b) Three Four (34) resident chambers shall be established in Kootenai
17 County;
18 (c) One (1) resident chambers shall be established in Shoshone County.
19 SECTION 2. That Section 1-804, Idaho Code, be, and the same is hereby
20 amended to read as follows:
21 1-804. THIRD DISTRICT -- NUMBER OF JUDGES -- RESIDENT CHAMBERS. (1) The
22 third judicial district shall consist of the counties of Adams, Washington,
23 Payette, Gem, Canyon and Owyhee.
24 (2) The third judicial district shall have five six (56) district judges.
25 (3) Resident chambers of the district judges of the third judicial dis-
26 trict shall be established as follows:
27 (a) One (1) resident chambers shall be established in Washington or Pay-
28 ette County.
29 (b) Four Five (45) resident chambers shall be established in Canyon
30 County.
STATEMENT OF PURPOSE
RS 15843
This bill would add two new district judges. One would be in the First
Judicial District and have resident chambers in Kootenai County; the other
would be in the Third Judicial District and have resident chambers in Canyon
County. These would be the first new district judge positions in Idaho since
1998. No district judge positions have been added in the First Judicial
District since 1997, and none in the Third Judicial District since 1996.
Since that time, the judiciary has been able to keep pace with the increasing
caseload by the use of senior judges and by having active judges assigned to
cases in districts other than their own when required. Idaho's increasing
population since 1995, up more than 40 percent in Kootenai County and more
than 51 percent in Canyon County and the corresponding demands on the court
system have now made it necessary to add judgeships. After reviewing
caseloads throughout the state, the Supreme Court has determined that the need
is most acute in the First and Third Judicial Districts.
FISCAL NOTE
The salary and benefits for two district judge positions and other
costs, including salary and benefits for two court reporters, would total
approximately $380,000 in general funds.
