  1                                        AN ACT
  2    RELATING TO STATEWIDE  COMMUNICATIONS  INTEROPERABILITY;  AMENDING  TITLE  46,
  3        IDAHO  CODE, BY THE ADDITION OF A NEW CHAPTER 12, TITLE 46, IDAHO CODE, TO
  4        DEFINE TERMS, TO CREATE THE  IDAHO  STATEWIDE  INTEROPERABILITY  EXECUTIVE
  5        COUNCIL  IN  THE IDAHO BUREAU OF HOMELAND SECURITY, TO PROVIDE FOR COUNCIL
  6        PURPOSE, TO PROVIDE FOR COUNCIL RESPONSIBILITIES, TO PROVIDE FOR RULES, TO
  7        ESTABLISH THE IDAHO STATEWIDE INTEROPERABILITY EXECUTIVE COUNCIL FUND,  TO
  8        PROVIDE  FOR  ADMINISTRATION OF THE FUND, TO PROVIDE FOR COUNCIL MEETINGS,
  9        TO PROVIDE FOR APPOINTMENT OF THE COUNCIL CHAIR AND VICE-CHAIR, TO PROVIDE
 10        FOR THE APPOINTMENT OF SUBCOMMITTEES, TO PROVIDE FOR APPOINTMENT OF  COUN-
 11        CIL  MEMBERS,  TO PROVIDE FOR MEMBER TERMS AND TO PROVIDE FOR COMPENSATION
 12        FOR COUNCIL MEMBERS; AND PROVIDING A SUNSET DATE.
                                                                        
 13    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 14        SECTION 1.  That Title 46, Idaho Code, be, and the same is hereby  amended
 15    by  the addition thereto of a NEW CHAPTER, to be known and designated as Chap-
 16    ter 12, Title 46, Idaho Code, and to read as follows:
                                                                        
 17                                      CHAPTER 12
 18                      STATEWIDE COMMUNICATIONS INTEROPERABILITY
                                                                        
 19        46-1201.  DEFINITIONS. As used in this chapter:
 20        (1)  "Cooperation" means to work or to act together towards a  common  end
 21    or purpose.
 22        (2)  "Coordination"  means  harmonious  adjustment or interaction of equal
 23    functions of similar importance.
 24        (3)  "Council" means the Idaho statewide interoperability executive  coun-
 25    cil.
 26        (4)  "Interoperability"  means  the  ability  of public safety service and
 27    support providers, law enforcement, firefighters, EMS,  emergency  management,
 28    public  utilities,  transportation  and  others, to communicate when necessary
 29    with staff from other responding agencies, and to exchange voice, video and/or
 30    data communications on demand, in real time, and when authorized.
                                                                        
 31        46-1202.  IDAHO STATEWIDE INTEROPERABILITY  EXECUTIVE  COUNCIL.  There  is
 32    hereby  created  in  the Idaho bureau of homeland security the Idaho statewide
 33    interoperability executive council to provide policy level direction and  pro-
 34    mote  efficient  and  effective use of resources for matters related to public
 35    safety wireless radio interoperability.
                                                                        
 36        46-1203.  PURPOSE. The council will serve as the governing body in affairs
 37    of public safety wireless radio interoperable  communications  for  local  and
 38    private  entities  and coordinate with the Idaho department of administration,
 39    which is responsible for state agency planning, to meet short-range and  long-
 40    range  telecommunications  needs  as authorized in chapter 57, title 67, Idaho

  1    Code. The council will promote interagency  cooperation  and  provide  support
  2    statewide  for  efficient  and effective use of local and private resources to
  3    achieve public safety wireless radio interoperable  communications  for  local
  4    and private public safety agencies.
                                                                        
  5        46-1204.  COUNCIL  RESPONSIBILITIES.  The  responsibilities of the council
  6    are to:
  7        (1)  Develop a statewide plan for local and private public safety wireless
  8    radio interoperable communications in coordination and  cooperation  with  the
  9    Idaho department of administration;
 10        (2)  Develop and adopt standards for local and private public safety wire-
 11    less  radio  interoperable communications in coordination and cooperation with
 12    the Idaho department of administration;
 13        (3)  Recommend guidelines and standards for operation for local  and  pri-
 14    vate  public  safety  wireless  radio  interoperable communications systems in
 15    Idaho in coordination and cooperation with the Idaho department of administra-
 16    tion;
 17        (4)  Promote coordination and cooperation among local, state, federal  and
 18    tribal  public  safety agencies in addressing statewide public safety wireless
 19    radio interoperable communications needs in Idaho;
 20        (5)  Review  priorities  for  statewide  public  safety   wireless   radio
 21    interoperable communications needs and assist users of the statewide system in
 22    the development of projects, plans, policies, standards, priorities and guide-
 23    lines for public safety wireless radio interoperable communications in coordi-
 24    nation and cooperation with the Idaho department of administration;
 25        (6)  Develop  funding  recommendations for short-term and long-term system
 26    maintenance;
 27        (7)  Research best practices of other states;
 28        (8)  Prepare and present a report to the information  technology  resource
 29    management  council  by December 30 of each year describing the council's acts
 30    and achievements of the previous year;
 31        (9)  Provide recommendations to the governor and the  legislature  of  the
 32    state  of Idaho, when appropriate, concerning issues related to local and pri-
 33    vate statewide public safety wireless radio  interoperable  communications  in
 34    Idaho and in accordance with homeland security presidential directives;
 35        (10) Report  annually  to  the  legislature  of  the state of Idaho on the
 36    planned expenditures for the next fiscal  year,  the  collected  revenues  and
 37    moneys disbursed from the Idaho statewide interoperability communications fund
 38    and programs or projects in progress, completed or anticipated;
 39        (11) Serve  as  a conduit for the future allocation of federal grant funds
 40    to support the delivery of public safety wireless radio interoperable communi-
 41    cations systems directed towards local government and private entities;
 42        (12) Enter into contracts with experts and/or consultants as may be neces-
 43    sary to carry out the purposes of this chapter and to sue and be sued; and
 44        (13) Work in coordination and cooperation with the Idaho emergency  commu-
 45    nications  commission  established  by  section  31-4815,  Idaho Code, and the
 46    information technology resource management  council,  established  by  section
 47    67-5745B, Idaho Code.
                                                                        
 48        46-1205.  RULES.  The council will promulgate rules pursuant to the provi-
 49    sions of chapter 52, title 67, Idaho Code, to carry out  its  responsibilities
 50    and purpose.
                                                                        
 51        46-1206.  IDAHO  STATEWIDE  INTEROPERABILITY  EXECUTIVE COUNCIL COMMUNICA-
 52    TIONS FUND -- ESTABLISHMENT AND ADMINISTRATION. (1) There  is  hereby  created

  1    within  the  treasury of the state of Idaho a separate fund known as the Idaho
  2    statewide interoperability communications fund, which shall consist of  moneys
  3    received from the state, counties, cities, public safety communications opera-
  4    tions,  grants, donations, gifts and revenues from any other source to support
  5    the delivery of public safety wireless radio interoperable communications sys-
  6    tems throughout the state.
  7        (2)  Moneys in the fund are hereby continuously appropriated and shall  be
  8    utilized  exclusively for the purposes set forth in this chapter as determined
  9    by the council.
 10        (3)  The council, through the Idaho bureau of homeland security, shall au-
 11    thorize disbursement of moneys in the fund to eligible entities  and  for  the
 12    support of this council.
                                                                        
 13        46-1207.  ADMINISTRATIVE SUPPORT. The council may, with concurrence of the
 14    governor  of  the state of Idaho, create the position of a project manager and
 15    the position of an administrative assistant, which positions shall  be  exempt
 16    from  the  requirements of the merit system, chapter 53, title 67, Idaho Code.
 17    In accordance with the laws  of  the  state,  the  Idaho  bureau  of  homeland
 18    security's  director  may  hire, fix the compensation and prescribe the powers
 19    and duties of such other individuals, including consultants, as may be  neces-
 20    sary to carry out the provisions of this chapter.
                                                                        
 21        46-1208.  MEETINGS.  The  council  will  meet  no less than four (4) times
 22    annually.
                                                                        
 23        46-1209.  CHAIR AND VICE-CHAIR. The governor shall appoint a chair and the
 24    council shall elect a vice-chair and other such officers as it may deem neces-
 25    sary and appropriate. The chair has  authority  and  is  responsible  for  all
 26    affairs of the council.
                                                                        
 27        46-1210.  SUBCOMMITTEES. The council will appoint subcommittees consistent
 28    with the needs of the council to address issues including, but not limited to:
 29        (1)  Technical  support and education issues regarding public safety wire-
 30    less radio interoperable communications in Idaho;
 31        (2)  Federal, state and local funding availability; and
 32        (3)  Outreach and liaison with federal and other state organizations work-
 33    ing on public safety wireless radio interoperable communications solutions.
                                                                        
 34        46-1211.  COUNCIL MEMBERS. (1) The council members shall be  appointed  by
 35    the governor and shall include at a minimum the representatives of the follow-
 36    ing organizations:
 37        (a)  One (1) representative from the Idaho transportation department;
 38        (b)  One (1) representative from the Idaho sheriffs' association;
 39        (c)  One (1) representative from the Idaho chiefs of police association;
 40        (d)  One (1) representative from the Idaho fire chiefs association;
 41        (e)  One (1) representative from the association of Idaho cities;
 42        (f)  One (1) representative from the Idaho association of counties;
 43        (g)  Two (2) representatives from the Idaho military division;
 44        (h)  One (1) representative from the Idaho department of administration;
 45        (i)  One (1) representative from the Idaho department of correction;
 46        (j)  One (1) representative from the Idaho state police;
 47        (k)  One (1) representative from the Idaho department of lands;
 48        (l)  One (1) representative from the Idaho department of fish and game;
 49        (m)  One  (1)  representative from the Idaho department of health and wel-
 50        fare;

  1        (n)  One (1) representative from Idaho tribal government; and
  2        (o)  Two (2) members at large.
  3        (2)  Additional voting members will be invited in  the  following  capaci-
  4    ties:
  5        (a)  One (1) liaison from federal law enforcement;
  6        (b)  One  (1)  liaison from the United States department of homeland secu-
  7        rity transportation security administration;
  8        (c)  One (1) liaison from the United States department  of  the  interior;
  9        and
 10        (d)  One (1) liaison from the national interagency fire center.
                                                                        
 11        46-1212.  COUNCIL  MEMBER  TERMS.  (1) Except as provided in this section,
 12    members of the council will be appointed for a term of four (4) years.
 13        (2)  The following five (5) members shall be appointed for an initial term
 14    of two (2) years:
 15        (a)  The member representing the Idaho fire chiefs association;
 16        (b)  The member representing the Idaho chiefs of police association;
 17        (c)  The member representing the Idaho sheriffs' association;
 18        (d)  The member representing the Idaho association of counties; and
 19        (e)  The member representing the association of Idaho cities.
 20        (3)  The following four (4) members will be appointed for an initial  term
 21    of three (3) years:
 22        (a)  The member representing the Idaho transportation department;
 23        (b)  The member representing the Idaho department of administration;
 24        (c)  The member representing the Idaho department of lands; and
 25        (d)  The member representing the Idaho department of health and welfare.
 26        (4)  Members  of  the  council shall be compensated as provided in section
 27    59-509(b), Idaho Code.
 28        (5)  New members may be added or members replaced at  annual,  special  or
 29    regular council meetings with approval from the office of the governor for the
 30    state  of  Idaho.  Upon  resignation  of  a member, the governor may appoint a
 31    replacement for the remainder of the vacated term.
                                                                        
 32        SECTION 2.  The provisions of this act shall be null, void and of no force
 33    and effect on and after December 31, 2012.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 16093

The Idaho Statewide Interoperability Executive Council existed by
Executive Order of the Governor. This legislation would create an
Idaho Statewide Interoperability Executive Council ("SIEC") and
define its governing structure. The purpose of the SIEC will be
to provide policy level direction, planning and promote efficient
and effective use of resources for matters related to local and
private public safety wireless radio interoperability; to work in
coordination and cooperation with the Idaho Bureau of Homeland
Security and the Idaho Department of Administration to advise the
Idaho Legislature, the Governor and other local, state, federal,
tribal and private sector agencies and organizations on public
safety wireless radio interoperable communications issues; to
support the development and publishing of information on the
condition and importance of public safety wireless radio
interoperable communications for protection of the state's
emergency responders, citizens, and economy; to assist with the
development and implementation of a state public safety wireless
radio interoperable communications strategic plan for public
safety communications technology; and to assist with the
coordination of local, state, federal and tribal interests to
increase the positive emergency preparedness impact of the
state's public safety communications resources.   


                           FISCAL NOTE

A federal grant currently funds the council's operating and
personnel expenditures. This grant will expire at the end of
calendar year 2007. Funding beyond calendar year 2007 (mid-FY
2008) has not been identified; however, the council will continue
to explore federal grant opportunities as well as other funding
alternatives to offset the estimated ongoing costs of $261,000.
