  1                                        AN ACT
  2    APPROPRIATING ADDITIONAL MONEYS TO THE DEPARTMENT OF HEALTH  AND  WELFARE  FOR
  3        MEDICAL  ASSISTANCE  SERVICES FOR ADMINISTRATION AND MANAGEMENT FOR FISCAL
  4        YEAR 2006; REDUCING THE APPROPRIATION TO THE DEPARTMENT OF HEALTH AND WEL-
  5        FARE FOR MEDICAL ASSISTANCE SERVICES FOR PROVIDER PAYMENTS FOR FISCAL YEAR
  6        2006; PROVIDING THAT THE STATE CONTROLLER SHALL MAKE  TRANSFERS  FROM  THE
  7        GENERAL FUND; AND DECLARING AN EMERGENCY.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  In  addition  to the appropriation made in Section 1, Chapter
 10    375, Laws of 2005, there is hereby appropriated to the  Department  of  Health
 11    and  Welfare  for  Medical  Assistance Services for administration and medical
 12    management the following amounts to be expended  according to  the  designated
 13    expense  class from the listed funds for the period July 1, 2005, through June
 14    30, 2006:

 21        SECTION 2.  The appropriation to the Department of Health and Welfare made
 22    in Section 2, Chapter 375, Laws of 2005, is hereby reduced  by  the  following
 23    amount from Medical Assistance Services for provider payments according to the
 24    designated  expense  class  from the listed funds for the period July 1, 2005,
 25    through June 30, 2006:

 33        SECTION 3.  GENERAL FUND TRANSFERS. As appropriated, the State  Controller
 34    shall  make  transfers  from the General Fund to the Cooperative Welfare Fund,
 35    periodically, as requested by the director of the  Department  of  Health  and
 36    Welfare and approved by the Board of Examiners.
                                                                        
 37        SECTION  4.  An  emergency  existing  therefor,  which emergency is hereby
 38    declared to exist, this act shall be in full force and effect on and after its
 39    passage and approval.

This is a Fiscal Year 2006 Supplemental Appropriation to the Department of Health & Welfare for the Medical Assistance Program. The Medical Assistance Program, or Medicaid, was provided additional funding to complete changes to the Medicaid Management Information System (MMIS) this fiscal year to implement the provisions of the Medicare Part D program. The system is being reprogrammed to meet federal requirements; correctly transfer pass information to and from the Centers for Medicare and Medicaid; correctly identify those dual eligible clients who are eligible for Medicare drug benefits; deny pharmacy claims for those dual eligibles whose drug claims should be paid by Medicare; and approve drugs excluded from the Medicare drug benefit but still allowed under Idaho Medicaid.

At the same time provider payments are being adjusted due to savings generated by transferring responsibility to Medicare for prescription drug benefit for seniors; additional costs due to 589 new eligibles identified during sign up of Medicare drug benefits; additional costs due to clawback where the federal government requires states to pay 90% of costs; and additional costs due to loss of prescription drug rebates/fewer purchases.

Fiscal Note

This bill provides an additional $135,000 from the General Fund, and $415,000 from federal funds for a total of $550,000 for one-time information system changes It also returns $3,706,700 in General Funds to the state treasury, and reduces the federal and dedicated funds appropriation by $29,042,600.
