]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE SENATE SENATE BILL NO. 1427 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO THE IDAHO SCHOOL FOR THE DEAF AND THE BLIND; AMENDING SECTION 3 33-3401, IDAHO CODE, TO ALLOW FOR EDUCATION SERVICES TO BE DELIVERED TO 4 STUDENTS RESIDING OUTSIDE THE CAMPUS AREA IN GOODING AND TO MAKE TECHNICAL 5 CORRECTIONS; AND AMENDING SECTION 33-3407, IDAHO CODE, TO REVISE THE DEFI- 6 NITION OF ELIGIBLE STUDENTS, TO REVISE PROCEDURES FOR OFFERING THE 7 SCHOOL'S SERVICES AND TO MAKE TECHNICAL CORRECTIONS. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 33-3401, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 33-3401. ESTABLISHMENT OF SCHOOL FOR THE DEAF AND THE BLIND. The estab- 12 lishment by law of a schoolfor theto provide supplemental education services 13 to deaf and blindat Gooding, Idaho,students statewide is hereby ratified and 14 affirmed., saidThese services may include residential and day campus programs 15 and an outreach program, intended to provide services to students outside the 16 campus area, as well as early intervention and family consultation. The 17 school is to be called the IdahoSschool for theDdeaf and theBblind, and its 18 operation continued. It is further provided that wherever the term "State 19 School for the Deaf and the Blind" shall appear in the Idaho Code it shall 20 mean "Idaho School for the Deaf and the Blind." 21 SECTION 2. That Section 33-3407, Idaho Code, be, and the same is hereby 22 amended to read as follows: 23 33-3407. DEFINITION OF THE DEAF AND THE BLIND -- EXAMINATION OF APPLI- 24 CANTS -- ADMISSION AND RELEASE OF PUPILS. All children between the ages of six 25 (6) and twenty-one (21) yearswho are too deaf or too blind to be educated in26the public schoolsqualify to receive special education services pursuant to 27 state or federal law as a result of a hearing or visual impairment, shall be 28 deemed deaf or blind for the purposes of this chapter. 29 Children who are under the age of six (6) years, but otherwise qualified, 30 may beadmittedserved, when, in the discretion of the superintendent but sub- 31 ject to the approval of the board of trustees, they are proper subjects to 32 receive training and educationavailable in the school and the facilities of33the school are adequate for proper care, training and educationfrom the 34 school, and the adequate facilities for proper education, training and/or care 35 are available. When it has been ascertained by the superintendent that any 36 pupil has ceased to make progress, or is no longer being benefited byattend-37ingthe school's services, upon recommendation of the superintendent and the 38 approval of the board of trustees such pupil may be released from the school 39 and/or school services may be discontinued. 40 The board of trustees is authorized to provide for the careful examination 41 of all applicants for admission to the school, and the expense of such exami- 2 1 nation is a lawful use of the moneys available to the board of trustees.
STATEMENT OF PURPOSE RS 16097 The purpose of this legislation is to remove outdated language applicable to the Idaho School for the Deaf and the Blind (ISDB) that has been in place for nearly 100 years and replacing it with language that provides clearer definitions. This includes making the statute consistent with historical practices of ISDB offering education services to eligible students residing outside the campus area. FISCAL IMPACT There will be no fiscal impact to the general fund.
