                            SENATE CONCURRENT RESOLUTION NO. 120

  1                               A CONCURRENT RESOLUTION
  2    PROPOSING AN AMENDMENT TO JOINT RULE 18 OF THE JOINT RULES OF THE  SENATE  AND
  3        THE HOUSE OF REPRESENTATIVES.
                                                                        
  4    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  5        WHEREAS, the Senate and the House of Representatives deem it necessary and
  6    desirable  to  amend  Joint  Rule  18 of the Joint Rules of the Senate and the
  7    House of Representatives.
  8        NOW, THEREFORE, BE IT RESOLVED by the members of the Second  Regular  Ses-
  9    sion of the Fifty-eighth Idaho Legislature, the Senate and the House of Repre-
 10    sentatives  concurring  therein,  that Joint Rule 18 of the Joint Rules of the
 11    Senate and the House of Representatives be amended to read as follows:
                                                                        
 12                                    JOINT RULE 18
 13        Statement of Purpose and Fiscal Notes.--No bill  shall  be  introduced  in
 14    either house unless it shall have attached thereto a concise statement of pur-
 15    pose and fiscal note. The contact person for the statement of purpose and fis-
 16    cal  note  shall  be  identified on the document. The statement of purpose and
 17    fiscal note applies only to a bill as introduced,  and  does  not  necessarily
 18    reflect  any amendment to the bill that may be adopted. A statement of purpose
 19    or fiscal note is not a statement of legislative intent.
 20        No bill making an appropriation, increasing or decreasing existing  appro-
 21    priations,  or  requiring  a future appropriation, or increasing or decreasing
 22    revenues of the state or any unit of local government, or requiring a signifi-
 23    cant expenditure of funds by the state or a unit of local government, shall be
 24    introduced unless it shall have attached thereto  a  fiscal  note.  This  note
 25    shall contain an estimate of the amount of such appropriation, expenditure, or
 26    change  under  the  bill.  The fiscal note shall identify a full fiscal year's
 27    impact of the legislation. Statements of purpose and fiscal notes may be  com-
 28    bined in the same statement.
 29        All  statements  of purpose and fiscal notes shall be reviewed for compli-
 30    ance with this rule by the committee to which the bill is assigned.  A  member
 31    may  challenge the sufficiency of a statement of purpose or fiscal note at any
 32    time prior to passage, except upon introduction. Nothing in  this  rule  shall
 33    prohibit  a  statement of purpose or fiscal note from being corrected or modi-
 34    fied.

This concurrent resolution would amend Joint Rule 18 to clarify
that statements of purpose and fiscal notes apply only to a bill as it
is introduced, and not necessarily to the bill as it might later be
amended. The concurrent resolution would not prohibit a statement of
purpose or fiscal note from being corrected or modified, but would not
require doing so.

This concurrent resolution would also attempt to advise all
parties, including judicial bodies, that a statement of purpose or
fiscal note should not be treated as a statement of legislative intent
by the Legislature.




                           FISCAL NOTE
                                
This resolution has no fiscal impact on the state general fund,
any other state funds or any local government funds.
