                            SENATE CONCURRENT RESOLUTION NO. 126
                                                                        
                              BY JUDICIARY AND RULES COMMITTEE
                                                                        
  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING PENDING RULES OF THE DEPART-
  3        MENT OF HEALTH AND WELFARE GOVERNING THE MEDICAL ASSISTANCE PROGRAM.
                                                                        
  4    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  5        WHEREAS, the Legislature is vested  with  authority  to  reject  executive
  6    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  7    that  the Legislature finds that the rules are not consistent with legislative
  8    intent; and
  9        WHEREAS, it is the finding of the Legislature that certain  rules  of  the
 10    Department  of Health and Welfare governing the Medical Assistance Program are
 11    not consistent with legislative intent and should be rejected.
 12        NOW, THEREFORE, BE IT RESOLVED by the members of the Second  Regular  Ses-
 13    sion of the Fifty-eighth Idaho Legislature, the Senate and the House of Repre-
 14    sentatives concurring therein, that IDAPA 16.03.09, rules of the Department of
 15    Health  and Welfare governing the Medical Assistance Program, adopted as pend-
 16    ing rules under Docket Number 16-0309-0503, the entire rulemaking docket,  be,
 17    and  the  same  is hereby rejected and declared null, void and of no force and
 18    effect.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 16149

This concurrent resolution would reject a pending rules of the
Department of Health and Welfare governing the medical assistance
program.  The effect of this resolution, if adopted by both
houses, would be to prevent the agency rule from going into
effect.



                           FISCAL NOTE

This concurrent resolution has no fiscal impact.
