]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 463 BY TRANSPORTATION AND DEFENSE COMMITTEE 1 AN ACT 2 RELATING TO TEMPORARY REGISTRATION OF COMMERCIAL MOTOR VEHICLES; AMENDING SEC- 3 TION 49-432, IDAHO CODE, TO PROVIDE A THIRTY DAY PENDING LEASE PERMIT, TO 4 CLARIFY USE OF A PENDING LEASE PERMIT AND TO DELETE REDUNDANT LANGUAGE. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 49-432, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 49-432. No permit or fee shall be transfer- 43 able or apportionable to any other vehicle, nor shall any such fee be 2 1 refundable. At the time of purchasing a permit, the applicant may purchase 2 additional permits in any combination which does not exceed a maximum of 3 ninety (90) days. 4 (3) A temporary permit shall be in a form, and issued under rules adopted 5 by the board, and shall be displayed at all times while the vehicle is being 6 operated on the highways by posting the permit upon the windshield of each 7 vehicle or in another prominent place, where it may be readily legible. 8 (4) Any permit issued pursuant to subsection (2) of this section shall be 9 purchased prior to movement of the vehicle on a highway, and such permit shall 10 be in addition to and available only to a vehicle which is currently and val- 11 idly registered in Idaho pursuant to section 49-432(1), 49-434(1), 12 49-434(8)(c) or 49-435, Idaho Code. 13 (5) The department may select vendors to serve as agents on state high- 14 ways for the purpose of selling permits where fixed ports of entry do not ade- 15 quately serve a respective highway entering the state. The vendor shall be 16 remunerated at the rate of three dollars ($3.00) per permit sold, and he shall 17 collect the fees specified in this section, and pay the fees to the depart- 18 ment. The vendor shall guarantee payment by giving a bond to the state in a 19 sum as shall be fixed by the board, the premium on the bond to be paid by the 20 department. 21(6) An owner-operator vehicle moving between lessee fleets where the22vehicle registration was issued in the name of the former lessee, shall be23eligible for a one hundred twenty (120) hour permit for the unladen movement24from the point of entry into the state to the destination of the new lessee's25place of business.

REVISED REVISED REVISED REVISED REVISED REVISED STATEMENT OF PURPOSE RS 15367C1 This legislation will amend Section 49-432, Idaho Code, to implement an internal audit recommendation to amend Idaho Code to reflect the actual time that the "Unladen Weight Permit" (owner/operators unladen only) is valid in order to conform to the provisions of the International Registration Plan Agreement. Idaho Code should state that these permits are good for thirty (30) days rather than for one-hundred twenty (120) hours as stated in current Idaho Code.
