]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 496 BY MATHEWS 1 AN ACT 2 RELATING TO APPROPRIATIONS AND STATE AGENCIES; AMENDING CHAPTER 36, TITLE 67, 3 IDAHO CODE, BY THE ADDITION OF A NEW SECTION 67-3615, IDAHO CODE, TO 4 REQUIRE LEGISLATIVE AUTHORIZATION BEFORE AN AGENCY MAY EXPEND AN APPROPRI- 5 ATION, TO PROVIDE PROCEDURES AND TO DEFINE "AGENCY." 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Chapter 36, Title 67, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 9 ignated as Section 67-3615, Idaho Code, and to read as follows: 10 67-3615. LEGISLATIVE AUTHORIZATION REQUIRED FOR APPROPRIATION. Unless the 11 legislature by law authorizes such action annually, neither the governor nor 12 any executive officer shall allow the expenditure of moneys nor shall any 13 agency expend moneys pursuant to an appropriation. To be authorized pursuant 14 to this section, an agency shall present testimony to the germane committee, 15 as determined by the president pro tempore of the senate and the speaker of 16 the house of representatives, of each house regarding the agency's role and 17 mission, goals and objectives of the agency and how well the agency is meeting 18 its goals and objectives. If the germane committee agrees that the agency 19 should be authorized, it shall prepare an enactment reauthorizing the agency. 20 Such enactment must pass both houses and be signed into law or allowed to 21 become law by the governor before an appropriation to the agency may be 22 enacted into law. A bill authorizing an agency shall be separate from any 23 appropriation bill to the agency. As used in this section, "agency" means each 24 state board, institution, commission, department or officer authorized by law 25 to make rules or to determine contested cases, but does not include the legis- 26 lative or judicial branches, executive officers listed in section 1, article 27 IV, of the constitution of the state of Idaho in the exercise of powers 28 derived directly and exclusively from the constitution, the state militia or 29 the state board of correction.
STATEMENT OF PURPOSE RS 15662 This proposed legislation amends Chapter 36, Title 67, Idaho Code, by adding a new section that requires legislative authorization before an agency may expend an appropriation.
