]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 597 BY AGRICULTURAL AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE IDAHO BEAN COMMISSION; AMENDING SECTION 22-2919, IDAHO CODE, 3 TO REVISE PROVISIONS RELATING TO THE DISBURSEMENT OF MONEYS FROM THE 4 ACCOUNTS OF THE IDAHO BEAN COMMISSION AND TO MAKE TECHNICAL CORRECTIONS. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 22-2919, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 22-2919. DEPOSIT AND DISBURSEMENT OF FUNDS. (1) Immediately upon receipt, 9 all moneys received by the commission shall be deposited in one (1) or more 10 separate accounts in the name of the commission in one (1) or more banks or 11 trust companies approved under chapter 27, title 67, Idaho Code, as state 12 depositories. The commission shall designate such banks or trust companies. 13 All funds so deposited are hereby continuously appropriated for the purpose of 14 carrying out the provisions of this chapter. 15 (2) Funds can be withdrawn or paid out of such accounts only upon checks 16 or other orders upon such accounts signed bytwoone (21) officersdesignated 17 by the commission. 18 (3) The right is reserved to the state of Idaho to audit the funds of the 19 commission at any time. 20 (4) On or before January 15 of each year, the commission shall file with 21 the senate agricultural affairs committee, the house of representatives agri- 22 cultural affairs committee, the legislative services office, the state con- 23 troller, and the division of financial management, a report showing the annual 24 income and expenses by standard classification of the commission during the 25 preceding fiscal year. The report shall also include an estimate of income to 26 the commission for the current and next fiscal year and a projection of antic- 27 ipated expenses by category for the current and next fiscal year. From and 28 after January 15, 1989, the report shall also include a reconciliation between 29 the estimated income and expenses projected and the actual income and expenses 30 of the preceding fiscal year. 31 (5) All moneys received or expended by the commission shall be audited 32 biennially by a certified public accountant designated by the commission, who 33 shall furnish a copy of such audit to the director of legislative services and 34 to the senate agricultural affairs committee and the house of representatives 35 agricultural affairs committee. The audit shall be completed within ninety 36 (90) days following the close of the fiscal year. 37 (6) The expenditures of the commission are expressly exempted from the 38 provisions of sections 67-2007 and 67-2008, Idaho Code.
STATEMENT OF PURPOSE RS 15877 Legislative auditors have indicated that it is no longer necessary for small agricultural commodity commissions to require two (2) signatures on checking accounts. The Idaho Bean Commission accounts are audited by legislative auditors every two years with the state reserving the right to audit the funds at any time. The audits will address each year separately. Commission members often live some distance apart and it is difficult to obtain two (2) signatures on checks. FISCAL IMPACT There is no impact to the general fund. Contact Name: Rep.
