  1                                        AN ACT
  2    RELATING TO PUBLIC ASSISTANCE LAW; AMENDING CHAPTER 2, TITLE 56,  IDAHO  CODE,
  3        BY  THE  ADDITION  OF  A  NEW  SECTION  56-209n, IDAHO CODE, TO DIRECT THE
  4        DEPARTMENT OF HEALTH AND WELFARE TO APPLY FOR FEDERAL WAIVERS FOR SPECIFIC
  5        REVISIONS TO THE STATE MEDICAID PROGRAM.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Chapter 2, Title 56, Idaho Code,  be,  and  the  same  is
  8    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
  9    ignated as Section 56-209n, Idaho Code, and to read as follows:
                                                                        
 10        56-209n.  ASSET REVIEWS. The director of the department of health and wel-
 11    fare is directed to apply for the appropriate waiver or waivers from the  cen-
 12    ters  for  medicare and medicaid services to enable the state medicaid program
 13    to:
 14        (1)  Increase the look-back period for  asset  transfers  from  three  (3)
 15    years to five (5) years;
 16        (2)  Begin the penalty period at the time of application or at the date of
 17    transfer, whichever is later; and
 18        (3)  Prevent  the  sheltering  of excess resources in annuities, trusts or
 19    promissory notes.

                       STATEMENT OF PURPOSE

                             RS 15463

     The purpose of this legislation is to direct the Department
of Health and Welfare to apply for waivers to place certain
restrictions on the sheltering of assets in order to qualify for
medicaid assistance. 


                           FISCAL NOTE

     None.  It probably will result in considerable savings to
the Department of Medicaid
