]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 751 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO POSTSECONDARY EDUCATION LOANS; AMENDING CHAPTER 43, TITLE 33, 3 IDAHO CODE, BY THE ADDITION OF A NEW SECTION 33-4317, IDAHO CODE, TO STATE 4 LEGISLATIVE INTENT, TO CREATE AN IDAHO MATH AND SCIENCE TEACHER LOAN PRO- 5 GRAM, TO PROVIDE FOR PROCEDURES, TO PROVIDE FOR LOAN FORGIVENESS, TO CRE- 6 ATE AN IDAHO MATH AND SCIENCE TEACHER LOAN FUND IN THE STATE TREASURY WITH 7 A ONE TIME APPROPRIATION OF FIVE MILLION DOLLARS AND TO DEFINE TERMS. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Chapter 43, Title 33, Idaho Code, be, and the same is 10 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 11 ignated as Section 33-4317, Idaho Code, and to read as follows: 12 33-4317. IDAHO MATH AND SCIENCE TEACHER LOAN PROGRAM. (1) Many of Idaho's 13 outstanding students are unable to attend Idaho postsecondary institutions. 14 Existing loan programs cannot provide the funding necessary to assist students 15 who qualify. Idaho is in need of trained individuals in the areas of mathemat- 16 ics, the sciences and nursing. It is legislative intent to create a permanent 17 fund to provide loans to Idaho students who, after graduation, will become 18 teachers of mathematics or science in the Idaho public schools or will prac- 19 tice nursing in Idaho. 20 (2) There is hereby created the Idaho math and science teacher loan pro- 21 gram. An eligible student may apply to the board for an Idaho math and science 22 teacher loan to meet the costs necessary for attendance at an eligible post- 23 secondary institution. 24 (3) The board shall implement and administer this loan program and shall 25 promulgate rules necessary to do so, including rules for: 26 (a) Processing and approving loan applications from eligible students; 27 (b) Determining, based on available funding, the number of Idaho loans to 28 be granted each academic year, the terms of each such loan and the amount 29 of each such loan; and 30 (c) Monitoring the progress of the eligible student in that student's 31 academic performance to ensure that the student: 32 (i) Maintains enrollment at an eligible postsecondary institution on 33 a full-time basis; and 34 (ii) Makes adequate progress towards a teaching degree in mathematics 35 or a field of science, or towards a degree in nursing, provided how- 36 ever, that for good cause shown, the board may permit the student to 37 suspend the student's study for up to two (2) years. 38 (4) For each full academic year that a student teaches in an Idaho school 39 or practices nursing within Idaho within seven (7) years following graduation 40 from an eligible postsecondary institution, one-fifth (1/5) of the loan prin- 41 cipal and accrued interest owed by the student shall be forgiven. 42 (5) The Idaho mathematics and science teacher loan fund is hereby created 43 in the state treasury. Income from the fund, including the repayment of loans, 2 1 shall be used to fund the Idaho math and science teacher loan program. The 2 fund principal shall consist of appropriations, repayment of principal and 3 interest, gifts, grants, donations and income from fund investments and inter- 4 est. The legislature shall appropriate five million dollars ($5,000,000) for 5 fiscal year 2007 to the fund. Moneys in the fund shall not revert to any other 6 fund at the end of the fiscal year. 7 (6) The following definitions shall apply to this section: 8 (a) "Board" means the state board of education. 9 (b) "Eligible postsecondary institution" means an Idaho public post- 10 secondary organization governed or supervised by the state board of educa- 11 tion, the board of regents of the university of Idaho, a board of trustees 12 of a community college established pursuant to the provisions of section 13 33-2106, Idaho Code, or the state board for professional-technical educa- 14 tion or any educational organization located in Idaho which is operated 15 privately and not for profit under the control of an independent board and 16 not directly controlled or administered by a public or political subdivi- 17 sion. 18 (c) "Eligible student" means a student who has graduated from an Idaho 19 secondary school.
STATEMENT OF PURPOSE RS 16014 This legislation relates to post-secondary education loans; amending, Chapter 43, Title 33, Idaho Code, by the addition of a new Section 33-4317, Idaho Code, to state legislative intent, to create an Idaho Math and Science Teacher loan program, to provide for procedures, to provide for loan forgiveness, to create an Idaho math and science teacher loan fund in the state treasury with a one time appropriation of five million dollars and to define terms. FISCAL NOTE There will be an impact of five million dollars on the State treasury.
