]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 795 BY WAYS AND MEANS COMMITTEE 1 AN ACT 2 RELATING TO SALARIES OF MEMBERS OF THE PUBLIC UTILITIES COMMISSION, THE STATE 3 TAX COMMISSION AND THE INDUSTRIAL COMMISSION; AMENDING SECTION 61-215, 4 IDAHO CODE, TO PROVIDE FOR AN INCREASE IN SALARY FOR MEMBERS OF THE PUBLIC 5 UTILITIES COMMISSION; AMENDING SECTION 63-102, IDAHO CODE, TO PROVIDE FOR 6 AN INCREASE IN SALARY FOR MEMBERS OF THE STATE TAX COMMISSION; AND AMEND- 7 ING SECTION 72-503, IDAHO CODE, TO PROVIDE FOR AN INCREASE IN SALARY FOR 8 MEMBERS OF THE INDUSTRIAL COMMISSION. 9 Be It Enacted by the Legislature of the State of Idaho: 10 SECTION 1. That Section 61-215, Idaho Code, be, and the same is hereby 11 amended to read as follows: 12 61-215. SALARIES OF PUBLIC UTILITIES COMMISSIONERS. Each member of the 13 public utilities commission shall devote full time to the performance of 14 his/her duties. Commencing on July 1, 20046, the annual salary of members of 15 the public utilities commission shall be eighty-twofive thousandseventwo 16 hundredfortytwenty-two dollars ($82,74085,222) and shall be paid from 17 sources set by the legislature. 18 SECTION 2. That Section 63-102, Idaho Code, be, and the same is hereby 19 amended to read as follows: 20 63-102. ORGANIZATION -- CHAIRMAN -- COMPENSATION -- QUORUM -- HEARINGS. 21 (1) A member of the state tax commission shall be appointed by the governor, 22 to serve at his pleasure, as chairman. Each member of the state tax commission 23 shall devote full time to the performance of duties. Commencing on July 1, 24 20046, the annual salary for members of the state tax commission shall be sev- 25 enty-onenine thousandseven hundred eightnine dollars ($71,70879,009). 26 (2) A majority of the state tax commission shall constitute a quorum for 27 the transaction of business. The state tax commission may delegate to any mem- 28 ber of the commission or to its employees, the power to make investigations 29 and hold hearings at any place it may deem proper, and such other matters as 30 will facilitate the operations of the commission. 31 (3) The chairman of the state tax commission shall delegate to each com- 32 missioner the responsibility for policy management and oversight of one (1) or 33 more of the taxes collected and/or activities supervised or administered by 34 the commission. The state tax commission shall perform the duties imposed upon 35 it by law and shall adopt all rules by majority decision. 36 In any case in which the state tax commission sits as an appellate body 37 upon an appeal from a tax decision from one (1) of the various administrative 38 units subject to its supervision, the state tax commissioner charged with 39 responsibility for policy management and oversight of the tax in controversy 40 shall not vote upon the appeal but may advise the remaining members of the 41 commission on the technical aspects of the problems before them. 2 1 (4) The chairman shall be the chief executive officer and administrative 2 head of the state tax commission and shall be responsible for, or may assign 3 responsibility for, all personnel, budgetary and/or fiscal matters of the 4 state tax commission. 5 SECTION 3. That Section 72-503, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 72-503. SALARY. Commencing July 1, 20046, the annual salary of each mem- 8 ber of the industrial commission shall be eighty-two thousandfivenine hun- 9 dredthirty-fivefifty-one dollars ($80,53582,951). Industrial commissioner 10 salaries shall be paid from sources set by the legislature. Each member of the 11 industrial commission shall devote full time to the performance of his duties.
STATEMENT OF PURPOSE RS 16224 This bill increases the salaries of the Public Utilities Commissioners, the Industrial Commissioners and the State Tax Commissioners by an amount equal to three percent (3%), effective July 1, 2006. This legislation also adds additional funding to align the State Tax Commissioners' salaries with that of the Public Utilities Commission and the Industrial Commissioners. FISCAL NOTE The annual salaries for Public Utilities Commissioners and Industrial Commissioners are paid from dedicated funds. The only fiscal impact to the general fund is in the amount of $30,283, which would be for a portion of the increase to the salaries of the State Tax Commissioners. Contact Name: Rep.
