]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE JOINT MEMORIAL NO. 18 BY EDUCATION COMMITTEE 1 A JOINT MEMORIAL 2 TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CONGRESS 3 ASSEMBLED, AND TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF 4 IDAHO IN THE CONGRESS OF THE UNITED STATES. 5 We, your Memorialists, the House of Representatives and the Senate of the 6 State of Idaho assembled in the Second Regular Session of the Fifty-eighth 7 Idaho Legislature, do hereby respectfully represent that: 8 WHEREAS, the success of all of America's students attending our nation's 9 public schools is of great concern to the citizens of the United States; and 10 WHEREAS, many of these students arrive at our public school classrooms 11 from myriad cultures and with no or extremely limited exposure to the English 12 language; and 13 WHEREAS, it is self-evident that a student new to the English language is 14 not proficient in reading or comprehending academic English; and 15 WHEREAS, the No Child Left Behind Act currently requires school districts 16 to include in determinations of adequate yearly progress (AYP) the participa- 17 tion of all limited English proficient students, including those who have not 18 been enrolled in school on a full-time basis for a sufficient period of time 19 to develop skills that will assure the required tests are providing reliable 20 information regarding these students' educational levels; and 21 WHEREAS, the No Child Left Behind Act also currently requires states to 22 include all students in their annual academic assessments, including those 23 with limited English proficiency, regardless of the length of time they have 24 been attending public school; and 25 WHEREAS, Idaho's statewide assessment used to meet the provisions of the 26 No Child Left Behind Act, the Idaho Standard Achievement Test, is administered 27 in English; and 28 WHEREAS, it is demoralizing and frustrating for a student to be forced to 29 take a test she or he cannot understand; and 30 WHEREAS, grade-level tests administered in English to beginning English 31 language learners do not help teachers or school administrators understand the 32 instructional needs of these students and do not provide an accurate portrayal 33 of the performance of the school in which these students are enrolled. 34 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 35 sion of the Fifty-eighth Idaho Legislature, the House of Representatives and 36 the Senate concurring therein, that we urge your support for and adoption of 37 amendments proposed to the No Child Left Behind Act contained in H.R. 1177 38 which would: 39 (1) Allow states to exclude from AYP determinations the performance of 40 any limited English proficient student who has not been enrolled in the state 41 for three (3) full school years and whose parents and educators agree that 42 such an exclusion is educationally appropriate for the student; and 43 (2) Allow states to exclude from the required annual academic assessment 44 of student performance in mathematics, reading or language arts and science 2 1 any limited English proficient student who has not been enrolled in the state 2 for three (3) full school years and whose parents and educators agree that 3 such an exclusion is educationally appropriate for the student. 4 BE IT FURTHER RESOLVED that the Chief Clerk of the House of Representa- 5 tives be, and she is hereby authorized and directed to forward a copy of this 6 Memorial to the President of the Senate and the Speaker of the House of Repre- 7 sentatives of Congress, and the congressional delegation representing the 8 State of Idaho in the Congress of the United States.

STATEMENT OF PURPOSE RS 16026 This joint memorial urges the United States Senate, the United States House of Representatives, and the Idaho Congressional Delegation to support two amendments to the No Child Left Behind Act relating to students enrolled in public schools who have limited English proficiency. Specifically, the memorial seeks adoption of proposed amendments contained in H.R. 1177 that would: Allow states to exclude from determinations of Adequate Yearly Progress (AYP) the performance of students with limited English proficiency who have not been enrolled in the state for three school years and whose parents and educators agree that such an exclusion is educationally appropriate for the student; and Allow states to exclude from the required annual academic assessment of student performance in mathematics, reading or language arts and science students with limited English proficiency who have not been enrolled in the state for three school years and whose parents and educators agree that such an exclusion is educationally appropriate for the student.
