2 PROPOSING AN AMENDMENT TO SECTION 1, ARTICLE IV, OF THE CONSTITUTION OF THE
3 STATE OF IDAHO, RELATING TO EXECUTIVE OFFICERS TO PROVIDE THAT THE TERM OF
4 OFFICE FOR GOVERNOR, LIEUTENANT GOVERNOR, SECRETARY OF STATE, STATE CON-
5 TROLLER, STATE TREASURER, ATTORNEY GENERAL AND SUPERINTENDENT OF PUBLIC
6 INSTRUCTION SHALL BEGIN AT NOON ON THE FIRST MONDAY IN JANUARY FOLLOWING
7 THE STATE EXECUTIVE OFFICER'S ELECTION; STATING THE QUESTION TO BE SUBMIT-
8 TED TO THE ELECTORATE; DIRECTING THE LEGISLATIVE COUNCIL TO PREPARE THE
9 STATEMENTS REQUIRED BY LAW; AND DIRECTING THE SECRETARY OF STATE TO PUB-
10 LISH THE AMENDMENT AND ARGUMENTS AS REQUIRED BY LAW.
11 Be It Resolved by the Legislature of the State of Idaho:
12 SECTION 1. That Section 1, Article IV, of the Constitution of the State
13 of Idaho be amended to read as follows:
14 SECTION 1. EXECUTIVE OFFICERS LISTED -- TERM OF OFFICE -- PLACE
15 OF RESIDENCE -- DUTIES. The executive department shall consist of a
16 governor, lieutenant governor, secretary of state, state controller,
17 state treasurer, attorney general and superintendent of public
18 instruction, each of whom shall hold his office for four years begin-
19 ning at noon on the first Monday in January next after his election,
20 commencing with those elected in the year 1946, except as otherwise
21 provided in this Constitution. The officers of the executive depart-
22 ment shall, during their terms of office, reside within the state.
23 Their official office shall be located in the county where the seat
24 of government is located, there they shall keep the public records,
25 books and papers. They shall perform such duties as are prescribed by
26 this Constitution and as may be prescribed by law, provided that the
27 state controller shall not perform any post-audit functions.
28 SECTION 2. The question to be submitted to the electors of the State of
29 Idaho at the next general election shall be as follows:
30 "Shall Section 1, Article IV, of the Constitution of the State of Idaho be
31 amended to provide that the term of office for governor, lieutenant governor,
32 secretary of state, state controller, state treasurer, attorney general and
33 superintendent of public instruction shall begin at noon on the first Monday
34 in January following the state executive officer's election?".
35 SECTION 3. The Legislative Council is directed to prepare the statements
36 required by Section 67-453, Idaho Code, and file the same.
37 SECTION 4. The Secretary of State is hereby directed to publish this pro-
38 posed constitutional amendment and arguments as required by law.
STATEMENT OF PURPOSE
RS 16206
The purpose of this legislation is to amend Section 1, Article
IV, of the Constitution of the State of Idaho, relating to
executive officers. This legislation provides that the term of
office for Governor, Lieutenant Governor, Secretary of State,
State Controller, State Treasurer, Attorney General and
Superintendent of Public Instruction shall begin at noon on the
first Monday in January following the State Executive Officer's
Election.
FISCAL NOTE
The fiscal impact to the General Fund will be $50,000.00 (fifty
thousand dollars) to cover costs of placing the measure on the
ballot.
