]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE SENATE SENATE BILL NO. 1308 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO POSTSECONDARY EDUCATION; AMENDING CHAPTER 37, TITLE 33, IDAHO 3 CODE, BY THE ADDITION OF A NEW SECTION 33-3726, IDAHO CODE, TO REQUIRE A 4 PUBLISHER OF A TEXTBOOK OR OTHER PRINTED INSTRUCTIONAL MATERIAL WHICH HAS 5 BEEN ADOPTED FOR INSTRUCTIONAL USE AT A POSTSECONDARY IDAHO INSTITUTION TO 6 FURNISH AN ELECTRONIC VERSION FOR USE BY A STUDENT WHO IS BLIND, VISUALLY 7 IMPAIRED, OR HAS A DIAGNOSED READING DISABILITY FOR A PRICE WHICH DOES NOT 8 EXCEED THE PRICE FOR THE EQUIVALENT PRINT VERSION, TO PROVIDE COPYRIGHT 9 PROTECTION OF PUBLISHERS AND TO PROVIDE PROCEDURE. 10 Be It Enacted by the Legislature of the State of Idaho: 11 SECTION 1. That Chapter 37, Title 33, Idaho Code, be, and the same is 12 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 13 ignated as Section 33-3726, Idaho Code, and to read as follows: 14 33-3726. ELECTRONIC TEXTBOOKS FOR VISUALLY IMPAIRED. (1) Upon request, a 15 publisher of a textbook or other printed instructional material that is 16 adopted for instructional use at a postsecondary educational institution in 17 Idaho shall furnish the institution with an electronic version of the publica- 18 tion which meets or exceeds current industry electronic file format and con- 19 tent standards or which is mutually agreed upon by the publisher and the 20 institution. The institution may use the electronic version to provide access 21 in Braille, audio or computer file to a student who is blind, is visually 22 impaired or has a diagnosed reading disability. A publisher shall not charge a 23 price for this electronic version that exceeds the price it charges for the 24 equivalent print version. 25 (2) A publisher may require that the request specified in subsection (1) 26 of this section must include a statement signed by the student agreeing to the 27 following: 28 (a) The student will use the electronic copy of the published printed 29 instructional material in specialized format solely for his or her own 30 educational purposes; and 31 (b) The student will not copy or duplicate the published printed instruc- 32 tional material or electronic copy for use by others consistent with the 33 requirements of the copyright revision act of 1976, 17 U.S.C. section 101, 34 et seq., as amended. 35 (3) Nothing in this section shall be deemed to authorize any use of the 36 published instructional materials that would constitute an infringement of 37 copyright under the copyright revision act of 1976, 17 U.S.C. section 101, et 38 seq., as amended.
STATEMENT OF PURPOSE RS 15680 The purpose of this legislation is to require publishers of textbooks and other printed instructional materials which have been adopted for instructional use by Idaho postsecondary educational institutions to provide an electronic version upon request of the institutions. This will allow the educational institutions to provide the materials in Braille, audio or other electronic format for students who are blind, visually impaired or have a diagnosed reading disability. The legislation also provides copyright protection for the publishers. FISCAL NOTE There is no fiscal impact to the General Fund or local government.
