  1                                        AN ACT
  2    APPROPRIATING MONEYS FOR THE STATE LIQUOR DISPENSARY  FOR  FISCAL  YEAR  2007;
  3        LIMITING THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS; CREATING THE LIQUOR
  4        WAREHOUSE  REMODEL  FUND; TRANSFERRING MONEYS FROM THE LIQUOR CONTROL FUND
  5        TO THE LIQUOR WAREHOUSE REMODEL FUND; DIRECTING THE ALLOCATION  OF  SALARY
  6        SAVINGS; AND DECLARING AN EMERGENCY.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  There is hereby appropriated to the Office of the Governor for
  9    the  State Liquor Dispensary the following amounts to be expended according to
 10    the designated expense classes from the listed fund for  the  period  July  1,
 11    2006, through June 30, 2007:

 23        SECTION  2.  In  accordance  with  Section  67-3519, Idaho Code, the State
 24    Liquor Dispensary is authorized no more than one hundred  eighty  (180)  full-
 25    time equivalent positions at any point during the period July 1, 2006, through
 26    June 30, 2007, for the program specified in Section 1 of this act, unless spe-
 27    cifically authorized by the Governor. The Joint Finance-Appropriations Commit-
 28    tee will be notified promptly of any increased positions so authorized.
                                                                        
 29        SECTION 3.  There is hereby created in the state treasury the Liquor Ware-
 30    house Remodel Fund, for the purpose of warehouse remodeling and warehouse sys-
 31    tem  improvements.  This  fund shall consist of moneys transferred to the fund
 32    pursuant to legislative action, and any interest earned on moneys in the  fund
 33    shall  be  credited  to  the Liquor Control Fund. The Liquor Warehouse Remodel
 34    Fund shall cease to exist on and after July 1, 2009.
                                                                        
 35        SECTION 4.  On or before June 30,  2006,  the  State  Controller,  at  the
 36    request  of  the  director  of  the  State  Liquor  Dispensary, shall transfer
 37    $2,000,000 from the Liquor Control Fund to the Liquor Warehouse Remodel Fund.
                                                                        
 38        SECTION 5.  The State Liquor Dispensary is  hereby  directed  to  allocate
 39    salary  savings,  based  on  performance, to provide for employee salary needs
 40    before other operational budget priorities are considered.  Where  applicable,

  1    employees  whose salaries are below the midpoint of their pay grade or occupa-
  2    tional groups with significant turnover rates shall be considered first in the
  3    order of salary savings distributions.
                                                                        
  4        SECTION 6.  An emergency existing  therefor,  which  emergency  is  hereby
  5    declared  to exist, Section 4 of this act shall be in full force and effect on
  6    and after its passage and approval.
