                            SENATE CONCURRENT RESOLUTION NO. 134
                                                                        
                              BY JUDICIARY AND RULES COMMITTEE
                                                                        
  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING PENDING RULES OF  THE  STATE
  3        BOARD OF EDUCATION GOVERNING THOROUGHNESS.
                                                                        
  4    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  5        WHEREAS,  the  Legislature  is  vested  with authority to reject executive
  6    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  7    that the Legislature finds that the rules are not consistent with  legislative
  8    intent; and
  9        WHEREAS,  it  is the finding of the Legislature that certain pending rules
 10    of the State Board of Education governing thoroughness are not consistent with
 11    legislative intent and should be rejected.
 12        NOW, THEREFORE, BE IT RESOLVED by the members of the Second  Regular  Ses-
 13    sion of the Fifty-eighth Idaho Legislature, the Senate and the House of Repre-
 14    sentatives    concurring  therein,  that  IDAPA 08.02.03, pending rules of the
 15    State Board of Education governing  thoroughness,  adopted  as  pending  rules
 16    under  Docket  Number  08-0203-0506, the entire rulemaking docket, be, and the
 17    same is hereby rejected and declared null, void and of no force and effect.

                       STATEMENT OF PURPOSE

                             RS 15768

This concurrent resolution rejects the rules of the State Board
of Education.

There is no fiscal impact.
