1 AN ACT
2 RELATING TO THE IDAHO RESIDENTIAL CARE ADMINISTRATORS ACT; AMENDING SECTION
3 54-4205, IDAHO CODE, TO INCREASE THE MAXIMUM ALLOWABLE FEES THE BOARD MAY
4 ESTABLISH BY RULE.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 54-4205, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 54-4205. FUNCTIONS AND DUTIES OF THE BOARD -- FEE FOR LICENSE APPLICANTS
9 -- RULES. (1) It shall be the functions and duties of such board to:
10 (a) Develop, impose and enforce standards consistent with this chapter
11 which shall be met by individuals in order to receive and retain a license
12 or permit as a residential care facility administrator. Such standards
13 shall be designed to ensure that residential care facility administrators
14 will be individuals who are of good character and are otherwise suitable,
15 and who, by training or experience in the field of institutional adminis-
16 tration, are qualified to serve as residential care facility administra-
17 tors;
18 (b) Develop and apply appropriate techniques, including examinations and
19 investigations, for determining whether an individual meets such stan-
20 dards;
21 (c) Issue licenses and permits to individuals determined, after applica-
22 tion of such techniques, to meet such standards, and revoke or suspend
23 licenses and permits previously issued by the board in any case where the
24 individual holding any such license or permit is determined to have vio-
25 lated the provisions of this chapter;
26 (d) Establish and carry out procedures designed to ensure that individu-
27 als licensed as residential care facility administrators will, during any
28 period that they serve as such, comply with the requirements of such stan-
29 dards;
30 (e) Receive, investigate and take appropriate action with respect to any
31 charge or complaint filed with the board charging that any individual
32 licensed as a residential care facility administrator has failed to comply
33 with the requirements of such standards;
34 (f) Conduct a continuing study and investigation of residential care
35 facility administrators to improve the standards imposed in order to
36 obtain a license or a permit and to improve the procedures and methods for
37 the enforcement of such standards with respect to those who have obtained
38 a license or a permit;
39 (g) The board shall establish by rule a fee schedule not to exceed one
40 two hundred dollars ($1200) each for applications for licenses, provi-
41 sional permits, annual renewal and applications for endorsement of a
42 license issued by the proper authorities in another state.
43 (2) The board or any committee or member thereof or any hearing officer

1 designated by such board, acting in an official capacity, shall have powers
2 and duties as provided by law. Such board shall not be bound by the strict
3 rules of evidence in the conduct of its proceedings but any determinations
4 made shall be founded upon sufficient legal evidence to sustain them.
5 (3) The board shall also have the authority to make rules not inconsis-
6 tent with law as may be necessary for the proper performance of its duties.
7 (4) The board shall have the authority to adopt a code of ethics for res-
8 idential care facility administrators in the state which shall be adopted in
9 compliance with chapter 52, title 67, Idaho Code.
STATEMENT OF PURPOSE
RS 16505
Amending section 54-4205, Idaho Code, to increase the cap for
each application, provisional permit, and annual renewal from
$100 to $200.
