  1                                        AN ACT
  2    RELATING TO ORGANIC FOOD PRODUCTS; AMENDING SECTION 22-1102,  IDAHO  CODE,  TO
  3        REVISE DEFINITIONS.
                                                                        
  4    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  5        SECTION  1.  That  Section 22-1102, Idaho Code, be, and the same is hereby
  6    amended to read as follows:
                                                                        
  7        22-1102.  DEFINITIONS. In this chapter:
  8        (1)  "Director" means the director of the department of agriculture or the
  9    director's designee.
 10        (2)  "Food  products"  shall  include  all  agricultural,   horticultural,
 11    viticultural  and  vegetable products of the soil, apiary and apiary products,
 12    poultry and poultry products, livestock and livestock products, milk and dairy
 13    products and aquaculture products.
 14        (3)  "Handler" means any person or organization who  processes,  packages,
 15    resells,  transports  or stores organic food products or nonorganic food prod-
 16    ucts engaged in the business of handling agricultural products, including pro-
 17    ducers who handle crops or livestock of their own production, except such term
 18    shall not include final retailers of agricultural products that do not process
 19    agricultural products.
 20        (4)  "Livestock" means any cattle, swine, sheep, goats, ratites,  domestic
 21    cervidae  and  bison swine, poultry, or equine animals used for food or in the
 22    production of food, fiber, feed, or other  agricultural-based  consumer  prod-
 23    ucts;  wild  or  domesticated  game;  or other nonplant life, except such term
 24    shall not include aquatic animals or bees for the production of  food,  fiber,
 25    feed, or other agricultural-based consumer products.
 26        (5)  "Organic  certification seal" means the design approved by the direc-
 27    tor and which when imprinted or affixed on labels, packages  or  products,  or
 28    used  in advertising in any manner, shall signify that the standards and rules
 29    developed in accordance with the provisions of this chapter and all other con-
 30    ditions of the provisions of this chapter have been met.
 31        (6)  "Organic food product" means any food product that is marketed  using
 32    the  term  organic,  or  any derivative of the term organic in its labeling or
 33    advertising. Organic foods are  those  processed,  packaged,  transported  and
 34    stored to retain maximum nutritional value, without the use of artificial pre-
 35    servatives, coloring or other additives, irradiation, or synthetic pesticides.
 36        (7)  "Organically  grown food products" means food products which are pro-
 37    duced without the use of synthetically compounded fertilizers, pesticides,  or
 38    growth  regulators  for a period not less than thirty-six (36) months prior to
 39    harvest. Organically grown food products are produced under the standards  and
 40    rules  established  in  accordance  with the provisions of this chapter and by
 41    other qualified agencies.
 42        (8)  "Person" means any an individual, partnership, association,  corpora-
 43    tion,  or  any organized group of persons whether incorporated or not associa-

  1    tion, cooperative, or other entity.
  2        (9)  "Producer" means any a person or organization who:
  3        (a)  Grows, raises or produces a food product; and
  4        (b)  Sells the food product as, or offers it for sale as, an organic  food
  5        engages  in  the  business  of growing or producing food, fiber, feed, and
  6        other agricultural-based consumer products.
  7        (10) "Vendor" means any person who sells organic food products to the con-
  8    sumer or another vendor.

                             RS 16593

This legislation will amend four definitions within the Organic 
Food Products Act; Handler, Livestock, Person and Producer. 
These changes will bring the state law into compliance with the 
National Organic Program Rules.



                          FISCAL NOTE

There is no fiscal impact to the General Fund.
