  1                                        AN ACT
  2    RELATING TO CONTRACTOR REGISTRATION; AMENDING SECTION 54-5213, IDAHO CODE,  TO
  3        REVISE  PROVISIONS RELATING TO RECIPROCAL REGISTRATION; DECLARING AN EMER-
  4        GENCY AND PROVIDING RETROACTIVE APPLICATION.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 54-5213, Idaho Code, be, and the same  is  hereby
  7    amended to read as follows:
                                                                        
  8        54-5213.  RECIPROCAL  REGISTRATION.  (1)  Nothing in this chapter shall be
  9    construed as preventing any On and after  January  1,  2007,  no  incorporated
 10    municipality, county, alternative form of local government, or other municipal
 11    or  political corporation or subdivision of this state from implementing shall
 12    implement its own regulation program for the registration or licensure of con-
 13    struction contractors, provided that no such code, ordinance, rule or  regula-
 14    tion enacted or adopted by such entity shall contain provisions less stringent
 15    than those requirements provided for by this chapter.
 16        (2)  A  contractor  may  provide  a verified copy of any current and unre-
 17    stricted license, registration, or other type of certification granted to  the
 18    contractor by any incorporated municipality, county, alternative form of local
 19    government, or other municipal or political corporation or subdivision of this
 20    state issued pursuant to a duly adopted and enacted ordinance prior to January
 21    1,  2007,  to  the board, for review, along with a reciprocal registration fee
 22    not to exceed fifty dollars ($50.00), as determined by board  rule,  which  is
 23    necessary  for  the  administration and processing of such application. If the
 24    review indicates that the license, registration or certification  was  granted
 25    under  provisions  that  were  not  less stringent than those provided by this
 26    chapter, the applicant shall be issued a registration  based  upon  reciprocal
 27    registration.
                                                                        
 28        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 29    declared to exist, this act shall be in full force and effect on and after its
 30    passage and approval, and retroactively to January 1, 2007.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 16771

     In 2005, the Idaho Legislature enacted the "Idaho Contractor
Registration Act."  Prior to its enactment, the state of Idaho had
no means of regulating incompetent, dishonest, or unprincipled
construction contractors.  Because the state had no system of
registration, three cities in Idaho created separate and distinct
contractor licensing programs.
     A significant reason for passing a statewide registration
program was to prevent "piece-meal" local contractor licensing
programs that would require contractors to purchase licenses in
multiple jurisdictions.  A state contractor registration system
provides uniformity in contractor requirements and avoids duplicate
and costly licensure fees.
     During the drafting of the state act, a provision was
negotiated to allow the three cities with contractor licensing
programs to continue their programs.  The statutory language was
too broadly worded.  Multiple other cities have now expressed
interest in creating costly local licensing programs.
     This legislation will prevent further "piece-meal" licensing
of construction contractors.  Further, it will grandfather in the
three cities with existing licensing programs.


                           FISCAL NOTE

There is no impact to the General Fund.
