  1                                        AN ACT
  2    RELATING TO DEVELOPMENT IMPACT FEES; AMENDING SECTION 67-8204A, IDAHO CODE, TO
  3        AUTHORIZE GOVERNMENTAL ENTITIES TO ENTER INTO INTERGOVERNMENTAL AGREEMENTS
  4        WITH ADDITIONAL DISTRICTS AS SPECIFIED.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 67-8204A, Idaho Code, be, and the same is  hereby
  7    amended to read as follows:
                                                                        
  8        67-8204A.  INTERGOVERNMENTAL  AGREEMENTS. Governmental entities as defined
  9    in section 67-8203(14), Idaho Code, which are jointly affected by  development
 10    are  authorized  to enter into intergovernmental agreements with each other or
 11    with highway districts, fire districts, water districts, sewer districts, rec-
 12    reational water and sewer districts or irrigation districts for the purpose of
 13    developing joint plans for capital improvements or for the purpose of agreeing
 14    to collect and expend development impact  fees  for  system  improvements,  or
 15    both,  provided  that  such agreement complies with any applicable state laws.
 16    Governmental entities are also authorized to enter into  agreements  with  the
 17    Idaho transportation department for the expenditure of development impact fees
 18    pursuant to a developer's agreement under section 67-8214, Idaho Code.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 17034

This legislation is intended to expand the authority of
governmental entities to enter into intergovernmental agreements
with any taxing district which provides any type of "public
facilities," as that term is defined in Section 67-8203,
Subsection (24), Idaho Code.  This amendment would allow
governmental entities authorized to impose impact fees the
authority to enter agreements and lawfully distribute such fees
to those taxing districts which provide "public facilities" and
are directly affected by new development.


                           FISCAL NOTE

There is no fiscal impact to the general fund.
