]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 211 BY REVENUE AND TAXATION COMMITTEE 1 AN ACT 2 RELATING TO BOND ELECTIONS; AMENDING CHAPTER 8, TITLE 63, IDAHO CODE, BY THE 3 ADDITION OF A NEW SECTION 63-802B, IDAHO CODE, TO PROVIDE FOR NOTIFICATION 4 OF RESIDENTS BY A TAXING DISTRICT WHEN THE DISTRICT IS HAVING AN ELECTION 5 TO INCUR BONDED INDEBTEDNESS, TO PROVIDE REQUIREMENTS OF THE NOTICE AND TO 6 PROVIDE CONSEQUENCES FOR FAILURE TO COMPLY WITH THE NOTICE PROVISIONS; AND 7 DECLARING AN EMERGENCY. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Chapter 8, Title 63, Idaho Code, be, and the same is 10 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 11 ignated as Section 63-802B, Idaho Code, and to read as follows: 12 63-802B. BOND ELECTIONS. In the case of an election to incur bonded 13 indebtedness, the taxing district shall mail a notice of the election to every 14 resident in the taxing district in a similar manner that property tax notices 15 are sent out and shall only state with specificity: the date of the election, 16 polling places, the time the polls will be open, the aggregate amount of taxes 17 that will be raised in the taxing district if the election is successful and 18 the increase that will occur per one hundred thousand dollars ($100,000) of 19 taxable value of property, above any exemptions, of residential property, com- 20 mercial property, industrial property, land actively devoted to agriculture 21 and operating property. The notice shall be mailed not less than fourteen (14) 22 calendar days prior to the day of the election. Failure to comply with this 23 section shall make the results of any election to incur bonded indebtedness 24 voidable. 25 SECTION 2. An emergency existing therefor, which emergency is hereby 26 declared to exist, this act shall be in full force and effect on and after its 27 passage and approval.
STATEMENT OF PURPOSE RS 16828C4 This legislation requires taxing districts, when holding an election to incur bonded indebtedness, to mail notices within fourteen (14) days of such elections to property taxpayers. FISCAL NOTE There is no fiscal impact to the general fund. There will be a cost to districts that hold elections to incur bond indebtedness.
