  1                                        AN ACT
  2    RELATING TO THE CAPITOL BUILDING;  STATING LEGISLATIVE  FINDINGS;  AUTHORIZING
  3        AND APPROVING THE USE OF CERTAIN FUNDS ALREADY PROVIDED THROUGH AGREEMENTS
  4        AND  AUTHORIZATIONS  FROM  THE  STATE BUILDING AUTHORITY; AMENDING SECTION
  5        67-1602, IDAHO CODE, TO REVISE ALLOCATION OF SPACE IN THE CAPITOL BUILDING
  6        BETWEEN THE LEGISLATIVE AND EXECUTIVE BRANCHES OF GOVERNMENT; AND  DECLAR-
  7        ING AN EMERGENCY.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  The Legislature finds that the authority to develop a Capitol
 10    Master Plan rests solely with the Idaho Capitol Commission pursuant to Section
 11    67-1608, Idaho Code. Further, the Capitol Master Plan approved by the  Capitol
 12    Commission,  which includes the restoration of the Capitol Building, construc-
 13    tion of single-story atrium wing additions at the east and west  ends  of  the
 14    Capitol   Building   of   approximately   25,000   square  feet  each,  and  a
 15    reconfiguration of space in the Capitol Building and which  provides  for  the
 16    allocation and control of the first floor of the Capitol Building to be by the
 17    legislative department, is hereby declared to be reasonable and necessary.
                                                                        
 18        SECTION  2.  The  Legislature  hereby  approves  and authorizes the use of
 19    funds for the modified Capitol Master Plan for the restoration  and  expansion
 20    of the Capitol Building that have already been provided through agreements and
 21    authorizations  from  the Idaho Capitol Commission, the Department of Adminis-
 22    tration and the Idaho State Building Authority pursuant  to  House  Concurrent
 23    Resolution  No.  47  adopted by the Second Regular Session of the Fifty-eighth
 24    Idaho Legislature in 2006. Such funds are hereby authorized for  the  restora-
 25    tion  and  refurbishment  of the  Capitol Building, the construction of single
 26    story atrium wing additions to the east and west ends of the Capitol Building,
 27    provisions to allow future connectivity between the  Capitol  Building  atrium
 28    wings  and  other adjoining state facilities in the Capitol Mall and, if there
 29    are funds available after the completion of the project herein described, such
 30    funds are to be applied to the debt service fund to pay principal and interest
 31    on bonds, thereby reducing annual rent in that year.
                                                                        
 32        SECTION 3.  That Section 67-1602, Idaho Code, be, and the same  is  hereby
 33    amended to read as follows:
                                                                        
 34        67-1602.  IDAHO  STATE  CAPITOL  --  ALLOCATION  AND CONTROL OF SPACE. The
 35    space within the interior of the capitol building shall be allocated and  con-
 36    trolled as follows:
 37        (1)  Public  space.  The  interior within the rotunda, the hallways on the
 38    first and second floors, the restrooms located adjacent  thereto,  the  eleva-
 39    tors,  the  stairways  between  the  first,  second,  third  and fourth floors
 40    (excepting the interior stairways between the third and fourth  floors  within
 41    the  legislative chambers), shall be space within the capitol building open to

  1    the public ("public space").  Subject to this chapter,  the  director  of  the
  2    department of administration shall maintain all public space.
  3        (2)  Executive  department. The governor shall determine the use and allo-
  4    cate the space within the first and second floors. The director of the depart-
  5    ment  of administration shall maintain such space.
  6        (3)  Legislative department. The legislative  department  shall  determine
  7    the  use  of  the  space  on the first, third and fourth floors as well as the
  8    basement, which basement shall include the underground atrium wings. All space
  9    within the first, third and fourth floors and the basement shall be  allocated
 10    by the presiding officers of the senate and house of representatives. The pre-
 11    siding  officers shall maintain such space and provide equipment and furniture
 12    thereto, provided however, that the presiding officers may contract  with  the
 13    director  of  the department of administration to maintain such space and pro-
 14    vide equipment and furniture thereto.
                                                                        
 15        SECTION 4.  An emergency existing  therefor,  which  emergency  is  hereby
 16    declared to exist, this act shall be in full force and effect on and after its
 17    passage and approval.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 17042

This legislation will provide the necessary authority to proceed
with the Capitol Building renovation and expansion project as
approved by the Idaho Capitol Commission. The Capitol Master Plan
has been modified to include the restoration of the Capitol
Building, the construction of single-story atrium wings at the
east and west ends of the Capitol Building, and a reconfiguration
of space in the Capitol Building which assigns control of the
first floor to the Legislature.

Section 2 of the bill is necessary to provide authority for use
of the funds which have already been authorized by HCR 47 in the
2006 Legislative Session.  Because the scope of the project has
been modified from two-story wings to single-story wings, this
change needs to be recognized by legislation and authority given
to utilize the funds for the modified Master Plan.

This legislation will complete the vision begun in 1998 to
restore and revitalize the most preeminent public building in
this state.  The new atrium wings will provide for expanded
hearing rooms, which are so badly needed for public participation
in the legislative process, and the long overdue restoration
effort will ensure that the Capitol Building, Idaho's symbol of
sovereignty, will be a source of pride for all Idahoans for years
to come. 

                                 
                          FISCAL NOTE

$130 million has been authorized through bonds for this project
with an annual bond payment of $20.1 million.  The bond payment
will be included in a separate appropriation bill.  Modifying the
project to single story wings should reduce the overall cost of
the project, and is expected to result in paying off the bonds
