  2    RELATING TO THE IDAHO BOND BANK AUTHORITY;  AMENDING  CHAPTER  87,  TITLE  67,
  3        IDAHO  CODE, BY THE ADDITION OF A NEW SECTION 67-8729, IDAHO CODE, TO CRE-
  4        ATE THE IDAHO BOND BANK ADMINISTRATIVE FUND AND TO PROVIDE FOR DEPOSITS TO
  5        THE FUND, APPROPRIATIONS FROM THE FUND AND USES OF THE FUND.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Chapter 87, Title 67, Idaho Code, be,  and  the  same  is
  8    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
  9    ignated as Section 67-8729, Idaho Code, and to read as follows:
                                                                        
 10        67-8729.  IDAHO BOND BANK ADMINISTRATIVE FUND. (1)  There is  hereby  cre-
 11    ated  in the state treasury the "Idaho Bond Bank Administrative Fund" to which
 12    shall be credited:
 13        (a)  Fees collected from municipalities  or  other  potential  sellers  of
 14        municipal  bonds in connection with application for and receipt of financ-
 15        ing under this chapter, and interest and other charges on or in connection
 16        with municipal bonds purchased as it may deem necessary or appropriate  to
 17        cover all costs and expenses of the authority and its operations;
 18        (b)  Fees  and charges collected to cover costs associated with the powers
 19        and duties of the authority as required in section 67-8705, Idaho Code;
 20        (c)  Interest earned on the investment of idle moneys in the  fund,  which
 21        shall be paid to the fund; and
 22        (d)  All other moneys as may be provided by law.
 23        (2)  Moneys  in  the  fund shall be continuously appropriated to the trea-
 24    surer of the state of Idaho, and any moneys remaining in the fund at  the  end
 25    of each fiscal year shall not be appropriated to any other fund.
 26        (3)  Moneys in the fund shall only be used to effect the purposes of chap-
 27    ter  87,  title  67,  Idaho  Code,  pursuant  to  the provisions as prescribed
 28    therein; provided however, the office of the state treasurer is authorized  to
 29    retain  a  portion of the moneys not to exceed ten percent (10%) of the fund's
 30    annual revenues to defray costs associated with the  implementation,  adminis-
 31    tration and oversight of the Idaho bond bank authority.

  2        On page 1 of the printed bill, in line 28, delete  "office  of  the  state
  3    treasurer"  and insert: "Idaho bond bank administrative fund"; and in line 29,
  4    delete "ten percent (10%)" and insert: "one-half of one percent (0.5%)".

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 16877

This legislation amends Chapter 87, Title 67 of the Idaho Code by
proposing the creation of an Idaho Bond Bank fund in the state
treasury. Administrative fees and service charges can be
collected and deposited to the fund. Monies in the fund will be
continuously appropriated.
                                 



                          FISCAL NOTE

There is no fiscal impact to the General Fund.
