  1                                        AN ACT
  2    RELATING TO BOND ELECTIONS; AMENDING CHAPTER 8, TITLE 63, IDAHO CODE,  BY  THE
  3        ADDITION OF A NEW SECTION 63-802B, IDAHO CODE, TO PROVIDE FOR NOTIFICATION
  4        WHEN  THE  DISTRICT IS HAVING AN ELECTION TO INCUR BONDED INDEBTEDNESS AND
  5        TO PROVIDE REQUIREMENTS OF THE NOTICE; AND DECLARING AN EMERGENCY.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Chapter 8, Title 63, Idaho Code,  be,  and  the  same  is
  8    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
  9    ignated as Section 63-802B, Idaho Code, and to read as follows:
                                                                        
 10        63-802B.  BOND ELECTIONS. In the case  of  an  election  to  incur  bonded
 11    indebtedness,  the  taxing  district  shall mail a notice of the election, not
 12    less than fourteen (14) calendar days prior to the election, to all residences
 13    within the taxing district or to residents of the taxing district who are eli-
 14    gible to vote in this election. The notice shall state with  specificity:  the
 15    purpose  of  the election,  the date of the election, polling places, the time
 16    the polls will be open, the aggregate amount of taxes that will be  raised  in
 17    the  taxing  district if the election is successful and the increase that will
 18    occur per one hundred thousand dollars ($100,000) of taxable  value  of  prop-
 19    erty,  above  any  exemptions,  of  residential property, commercial property,
 20    industrial property, land actively devoted to agriculture and operating  prop-
 21    erty.
                                                                        
 22        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 23    declared to exist, this act shall be in full force and effect on and after its
 24    passage and approval.

                       STATEMENT OF PURPOSE

                            RS 17112C2

This legislation requires taxing districts, when the district is
having an election to incur bonded indebtedness, to mail notices
within fourteen (14) days of such elections to property taxpayers.


                           FISCAL NOTE

     There is no fiscal impact to the general fund.  There will be
a cost to districts that hold elections to incur bond indebtedness.
