  2    RELATING TO SCHOLARSHIPS; AMENDING CHAPTER 43, TITLE 33, IDAHO  CODE,  BY  THE
  3        ADDITION  OF  A  NEW  SECTION  33-4316, IDAHO CODE, TO PROVIDE LEGISLATIVE
  4        INTENT, TO PROVIDE FOR THE CREATION OF THE ALEXIS SCHOLARSHIP FUND IN  THE
  5        STATE  TREASURY,  TO  PROVIDE ELIGIBILITY CRITERIA FOR THE SCHOLARSHIP, TO
  6        PROVIDE DUTIES OF THE SUPERINTENDENT OF PUBLIC INSTRUCTION AND STATE TREA-
  7        SURER AND TO PROVIDE PROCEDURES IF THERE ARE MORE QUALIFYING STUDENTS THAN
  8        THERE ARE MONEYS IN THE FUND.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION 1.  That Chapter 43, Title 33, Idaho Code, be,  and  the  same  is
 11    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 12    ignated as Section 33-4316, Idaho Code, and to read as follows:
                                                                        
 13        33-4316.  ALEXIS SCHOLARSHIP FUND. Recognizing that regular attendance  in
 14    school  goes  hand  in hand with academic achievement, it is the intent of the
 15    legislature to provide an incentive and encourage personal responsibility  for
 16    parents and children to save for their higher education needs. There is hereby
 17    created  in  the state treasury, the Alexis scholarship fund, for which moneys
 18    in the fund shall be utilized to provide a fifty dollar  ($50.00)  scholarship
 19    for  an Idaho student who achieves perfect attendance during the entire school
 20    year at any Idaho public school. The principal at the student's  school  shall
 21    forward to the superintendent of public instruction before July 1 of each year
 22    a list of all students who achieved perfect attendance during the school year.
 23    The superintendent of public instruction shall then notify the state treasurer
 24    of  the  names  and  addresses of all qualifying students. The state treasurer
 25    shall then transfer and deposit fifty dollars ($50.00) to an account that  has
 26    been  established in the student's name in the college savings program created
 27    in chapter 54, title 33, Idaho Code, within funds appropriated to this fund.
 28        The Alexis scholarship fund shall be  credited  all  moneys  that  may  be
 29    appropriated,  apportioned,  allocated  and  paid back to that fund. Moneys in
 30    this fund shall be used exclusively as provided in this section and  are  per-
 31    petually  appropriated  to the state treasurer for such purposes as authorized
 32    by this section. Moneys in the fund shall be invested by the  state  treasurer
 33    in the same manner as provided under section 67-1210, Idaho Code, with respect
 34    to  other  idle   moneys in the state treasury. Interest earned on the invest-
 35    ments shall be credited to the fund.
 36        Moneys for the Alexis scholarship shall be awarded in the  order  received
 37    by the state treasurer from the superintendent of public instruction. If there
 38    are  more students qualifying for scholarships than there are funds available,
 39    scholarships shall be awarded in the order the  names  were  received  by  the
 40    state  treasurer from the superintendent of public instruction. Those students
 41    who qualified for a scholarship when funds were not available shall have first
 42    priority to receive moneys contributed in their name in  the  college  savings
 43    program when funds become available.

                       STATEMENT OF PURPOSE

                            RS 17137

This legislation creates the Alexis Scholarship Fund to provide a
scholarship to any Idaho student who achieves perfect attendance
at any Idaho public school in any year.  The intent of this
legislation is to provide an incentive for children to achieve
regular attendance in school, and to encourage individual
responsibility in saving for college.


                          FISCAL IMPACT

A one-time general fund appropriation of $655,000.00 to establish
the Alexis Scholarship Fund.  Additional ongoing appropriations
from the general fund may be deposited into the fund to continue
the program based on need.
