  1                                        AN ACT
  2    APPROPRIATING MONEYS FOR THE IDAHO STATE INDEPENDENT LIVING COUNCIL FOR FISCAL
  3        YEAR 2008; LIMITING THE NUMBER OF FULL-TIME EQUIVALENT  POSITIONS;  APPRO-
  4        PRIATING  MONEYS  TO  THE STATE INDEPENDENT LIVING COUNCIL FUND; DIRECTING
  5        THE DISTRIBUTION OF THE FUNDING FOR EMPLOYEE COMPENSATION;  AND  DIRECTING
  6        THE ALLOCATION OF SALARY SAVINGS.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  There  is hereby appropriated to the State Independent Living
  9    Council, the following amounts to be expended from the listed  funds  for  the
 10    period July 1, 2007, through June 30, 2008.
 11    FROM:

 13    State Independent Living Council (Ded) Fund                            130,600
 14    State Independent Living Council (Fed) Fund                            253,700
 15      TOTAL                                                               $507,400
                                                                        
 16        SECTION  2.  In  accordance  with  Section  67-3519, Idaho Code, the Idaho
 17    State Independent Living Council is authorized no more  than  four  and  five-
 18    tenths  (4.5)  full-time  equivalent  positions at any point during the period
 19    July 1, 2007, through June 30, 2008, for the program specified in Section 1 of
 20    this act, unless specifically authorized by the Governor. The  Joint  Finance-
 21    Appropriations  Committee will be notified promptly of any increased positions
 22    so authorized.
                                                                        
 23        SECTION 3.  There is hereby appropriated $123,100 from the General Fund to
 24    be deposited in the State Independent Living Council Fund for the period  July
 25    1, 2007, through June 30, 2008.
                                                                        
 26        SECTION  4.  Agencies  and  institutions  shall distribute the funding for
 27    employee compensation based on merit as follows:
 28        (a)  Agencies and institutions are directed to,  based  on  merit,  target
 29        funding  first  toward high turnover classifications and individuals below
 30        midpoint within their agency.
 31        (b)  Agencies and institutions are directed to,  based  on  merit,  target
 32        funding  second toward positions within their agency that are below ninety
 33        percent (90%) of the Compa-Ratio.
 34        (c)  Agencies and institutions are directed to target any remaining  fund-
 35        ing based on merit using the merit matrix required by Idaho Code.
 36    Agencies  and institutions shall create compensation and distribution plans to
 37    ensure that they are consistent with the  policies  contained  herein.  Agency
 38    directors and institutional presidents shall approve all compensation and dis-
 39    tribution plans and ensure that implementation of the plans is consistent with
 40    policies  contained  herein.  Each  agency  and institution shall forward, for
 41    informational purposes, approved copies of the compensation  and  distribution

  1    plans to the Legislative Services Office and the Division of Financial Manage-
  2    ment  by  June 1, 2007. The effective date of implementation of ongoing salary
  3    adjustments shall be June 17, 2007.
                                                                        
  4        SECTION 5.  The Idaho State Independent Living Council is hereby  directed
  5    to allocate salary savings, based on performance, to provide for employee sal-
  6    ary  needs  before  other  operational budget priorities are considered. Where
  7    applicable, employees whose salaries are below the midpoint of their pay grade
  8    or occupational groups with significant turnover  rates  shall  be  considered
  9    first in the order of salary savings distributions.
