]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 308 BY APPROPRIATIONS COMMITTEE 1 AN ACT 2 RELATING TO THE LEGISLATIVE ACCOUNT; AMENDING SECTION 67-451, IDAHO CODE, TO 3 INCREASE THE AMOUNT OF TRANSFERS FROM THE GENERAL FUND INTO THE LEGISLA- 4 TIVE ACCOUNT; AND PROVIDING AN EFFECTIVE DATE. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 67-451, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 67-451. LEGISLATIVE ACCOUNT CREATED -- DUTIES OF CONTROLLER -- DISBURSE- 9 MENTS FROM ACCOUNT -- REPORT OF DISBURSEMENTS. (1) There is hereby created in 10 the state treasury the legislative account. The legislative account shall con- 11 sist of such moneys as are placed into it by other appropriations, by receipts 12 paid into the legislative account, and the moneys appropriated and transferred 13 into it according to the provisions of this act. 14 (2) There is hereby appropriated out of the general fund and transferred 15 into the legislative account, and commencingJune 1, 2001January 1, 2008, 16 the state controller is authorized and directed to make such transfers in the 17 amounts shown on each of the following dates in each year: 18 January 1 $1,520,0001,825,000 19 March 1 $1,520,0001,825,000 20 June 1 $1,175,0001,445,000 21 September 1 $1,385,0001,660,000 22 (3) The president pro tempore of the senate and the speaker of the house 23 of representatives are hereby authorized to make expenditures out of the leg- 24 islative account for any necessary expenses of the legislature and the legis- 25 lative account is hereby perpetually appropriated for any necessary expenses 26 of the legislature. Necessary expenses of the legislature shall include, but 27 are not necessarily limited to, salaries and wages of officers, members, and 28 employees of the legislature, consultants and other expert or professional 29 personnel, travel expenses of officers, members, and employees of the legisla- 30 ture, other current expenses incurred in any operation or function of the leg- 31 islature, premiums for life, accidental death and dismemberment, hospital, 32 medical, surgical and major medical insurance for members of the legislature 33 during their terms of office, and for employees of the legislature during the 34 period of their employment, and capital outlay items necessary for any opera- 35 tion or function of the legislature. The signature of the president pro tem- 36 pore of the senate or the speaker of the house of representatives on any 37 voucher or claim for payment shall be sufficient authority for the state con- 38 troller to pay the same. Expenses for any interim activity of the legislature 39 or legislators shall be paid in the same manner. Expenses for any interim leg- 40 islative committees shall be paid in the same manner, if previously authorized 41 by concurrent resolution. 42 (4) The state controller is hereby directed to devise and implement a 43 financial reporting and control system for the purposes of this act that 2 1 exempts legislative expenditures from any other provision of law, and the leg- 2 islative account shall be specifically exempt from the provisions of chapter 3 35, title 67, Idaho Code, and shall be specifically exempt from the provisions 4 of chapter 36, title 67, Idaho Code. Such system must produce a report as of 5 the end of each calendar month that clearly shows additions to the account, 6 the unexpended balance in the account, the expenditures to date, and the 7 expenditures for the month reported, suitably detailed in such manner as the 8 presiding officers may instruct the state controller. A copy of such report 9 must be delivered to the president pro tempore of the senate and the speaker 10 of the house of representatives and to the governor by no later than the fifth 11 working day of the following month. 12 SECTION 2. This act shall be in full force and effect on and after Janu- 13 ary 1, 2008.

This bill increases the amount transferred from the General Fund to the Senate and House legislative accounts in accordance with Section 67-451, Idaho Code. These transfers occur each January 1, March 1, June 1, and September 1. Currently the amount transferred each year is $5,600,000, split 40:60 between the Senate and the House of Representatives. This change impacts the transfer beginning on January 1, 2008. The new annual transfer will total $6,755,000 in FY 2009 and will result in a 37:63 split which is a reflection of current needs related to personnel, benefits, and per diem costs.
The last statutory change to the funding level for the Legislature was in 2001. The Legislature did reduce it’s transfer on a temporary basis during budget holdbacks in FY 2003 and FY 2004.

The impact to the General Fund is $880,000 in FY 2008, and $1,155,000 in future years. The total amount of the legislative transfer will be $6,755,000 each year.
