1 AN ACT
2 APPROPRIATING MONEYS FROM THE PERMANENT BUILDING FUND TO THE DIVISION OF PUB-
3 LIC WORKS FOR THE VARIOUS PURPOSES SPECIFIED; EXPRESSING LEGISLATIVE
4 INTENT CONCERNING THE USE OF MONEYS APPROPRIATED IN THIS ACT; EXEMPTING
5 THE APPROPRIATIONS FROM THE PROVISIONS OF CHAPTER 36, TITLE 67, IDAHO
6 CODE, AND FROM THE PROVISIONS OF SECTION 67-3516, IDAHO CODE; AUTHORIZING
7 THE USE OF TAX ANTICIPATION NOTES; DIRECTING THE TRANSFER OF MONEYS FROM
8 THE GENERAL FUND TO THE PERMANENT BUILDING FUND FOR FISCAL YEAR 2007;
9 EXPRESSING LEGISLATIVE INTENT CONCERNING THE APPROPRIATION FOR THE CENTER
10 FOR LIVESTOCK AND ENVIRONMENTAL STUDIES; PROVIDING FOR NONSEVERABILITY OF
11 THIS ACT; AND DECLARING AN EMERGENCY FOR SPECIFIED SECTIONS OF THIS ACT.
12 Be It Enacted by the Legislature of the State of Idaho:
13 SECTION 1. There is hereby appropriated from the Permanent Building Fund
14 to the Division of Public Works the following amounts, or so much thereof as
15 in each case may be necessary, for the purpose of paying the cost of any land,
16 building, equipment, or the rebuilding, renovation or repair, of buildings,
17 installations, facilities or structures at the places, institutions and agen-
18 cies, or their successors, including those listed in this section. The Perma-
19 nent Building Fund Advisory Council is hereby authorized and directed to
20 anticipate revenues accruing to the Permanent Building Fund for the purpose of
21 undertaking the construction, renovation, repair and acquisitions herein
22 authorized, without delay, and to determine the priority of construction pur-
23 suant to which the work hereunder will be undertaken.

12 SECTION 2. It is legislative intent that the moneys appropriated in this
13 act may be made available for matching any allocation of moneys now in exis-
14 tence or hereafter made available by agencies of the United States and/or pri-
15 vate donations; and it is further the express intention of the Legislature to
16 authorize the Division of Public Works to expend, for the purpose of paying
17 the cost of any land, building, equipment or the rebuilding, renovation or
18 repair of buildings, moneys appropriated for public works to various agencies
19 as part of the respective agency operating budgets; provided the express
20 approval by the Permanent Building Fund Advisory Council is granted to make
21 application for such moneys in each instance.
22 SECTION 3. All appropriations made herein shall be exempt from the provi-
23 sions of Chapter 36, Title 67, and Section 67-3516, Idaho Code, but shall be
24 available for expenditure only after allotment in accordance with the other
25 provisions of Chapter 35, Title 67, Idaho Code, and all appropriations made
26 hereunder shall be subject to the provisions of Section 67-5711, Idaho Code,
27 except as otherwise provided herein.
28 SECTION 4. The State Treasurer is hereby authorized and directed to
29 anticipate the revenues in the Permanent Building Fund by the issuance of tax
30 anticipation notes in accordance with authority conferred in Sections 63-3201
31 through 63-3204, Idaho Code, and in accordance with the procedures and subject
32 to the limitations provided in those sections, in the same manner as though
33 the revenues in the General Fund were being anticipated.
34 SECTION 5. The State Controller is hereby directed to transfer on the
35 effective date of this section or as soon thereafter as is practicable,
36 $98,363,600 from the General Fund to the Permanent Building Fund.
37 SECTION 6. It is legislative intent that the $10 million appropriated in
38 this act for the Center for Livestock and Environmental Studies (CLES) is con-
39 tingent upon amendment of the federal Morrill Act (7 U.S.C. 301 et seq.) for
40 the purpose of allowing the State Board of Land Commissioners to sell or
41 exchange Agricultural College Endowment lands, and use the equity in those
42 lands for the acquisition of land and the construction of buildings and other
43 real estate improvements necessary for the construction of the CLES facili-
44 ties.
45 Upon amendment of the Morrill Act, the University of Idaho College of
46 Agricultural and Life Sciences shall seek final recommendation from the Gover-
47 nor, and final authorization and approval from the State Board of Education
48 and the Board of Regents of the University of Idaho and the Joint Finance-
49 Appropriations Committee prior to the release of the $10 million appropriated
50 in this act.

1 After the initial build-out and start-up of the CLES full-scale operating
2 dairy platform, no further funds from the state of Idaho, University of Idaho,
3 or state agency shall be expended on the operation or maintenance of the oper-
4 ating dairy platform.
5 In the event the Morrill Act is not amended within twenty-four (24) months
6 of the enactment of this act, the $10 million appropriated in this act shall
7 remain in the Permanent Building Fund for future allocation to statewide
8 alterations and repairs.
9 SECTION 7. NONSEVERABILITY. The provisions of this act are hereby
10 declared to be nonseverable and if any provision of this act is declared
11 invalid for any reason, such declaration shall affect the validity of the
12 remaining portions of this act and the remaining portions of this act shall be
13 null, void and of no force and effect.
14 SECTION 8. An emergency existing therefor, which emergency is hereby
15 declared to exist, Section 5 and funding for the project in subsection E.(3)
16 of Section 1 of this act shall be in full force and effect on and after pas-
17 sage and approval.

This is the fiscal year 2008 appropriation bill for the Permanent Building Fund in the amount of $137,974,000. This budget is funded with dedicated funds and also includes a one-time transfer from the General Fund of $98,363,600. This bill provides $69,558,900 for state-wide alteration and repair projects. This bill also provides funding for eleven additional capital projects.
