BY APPROPRIATIONS COMMITTEE
1 AN ACT
2 APPROPRIATING MONEYS TO THE IDAHO STATE LOTTERY FOR FISCAL YEAR 2008; LIMITING
3 THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS; EXPRESSING LEGISLATIVE
4 INTENT TO CLARIFY THE SCOPE OF THE APPROPRIATION; DIRECTING THE DISTRIBU-
5 TION OF THE FUNDING FOR EMPLOYEE COMPENSATION; AND DIRECTING THE ALLOCA-
6 TION OF SALARY SAVINGS.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. There is hereby appropriated to the Idaho State Lottery in the
9 Department of Self-Governing Agencies the following amounts to be expended for
10 administrative costs according to the designated expense classes from the
11 listed fund for the period July 1, 2007, through June 30, 2008:
12 FOR:
13 Personnel Costs $ 2,689,800
14 Operating Expenditures 8,279,100
15 Capital Outlay 108,900
16 TOTAL $11,077,800

18 State Lottery Fund $11,077,800
19 SECTION 2. In accordance with Section 67-3519, Idaho Code, the Idaho
20 State Lottery is authorized no more than forty-seven (47) full-time equivalent
21 positions at any point during the period July 1, 2007, through June 30, 2008,
22 unless specifically authorized by the Governor. The Joint Finance-
23 Appropriations Committee will be notified promptly of any increased positions
24 so authorized.
25 SECTION 3. It is legislative intent that amounts necessary to pay prizes,
26 retailer commissions, advertising and promotional costs shall be continuously
27 appropriated to the Idaho State Lottery under the provisions of Section
28 67-7428, Idaho Code.
29 SECTION 4. Agencies and institutions shall distribute the funding for
30 employee compensation based on merit as follows:
31 (a) Agencies and institutions are directed to, based on merit, target
32 funding first toward high turnover classifications and individuals below
33 midpoint within their agency.
34 (b) Agencies and institutions are directed to, based on merit, target
35 funding second toward positions within their agency that are below ninety
36 percent (90%) of the Compa-Ratio.
37 (c) Agencies and institutions are directed to target any remaining fund-
38 ing based on merit using the merit matrix required by Idaho Code.
39 Agencies and institutions shall create compensation and distribution plans to
40 ensure that they are consistent with the policies contained herein. Agency
41 directors and institutional presidents shall approve all compensation and dis-

1 tribution plans and ensure that implementation of the plans is consistent with
2 policies contained herein. Each agency and institution shall forward, for
3 informational purposes, approved copies of the compensation and distribution
4 plans to the Legislative Services Office and the Division of Financial Manage-
5 ment by June 1, 2007. The effective date of implementation of ongoing salary
6 adjustments shall be June 17, 2007.
7 SECTION 5. The Idaho State Lottery is hereby directed to allocate salary
8 savings, based on performance, to provide for employee salary needs before
9 other operational budget priorities are considered. Where applicable, employ-
10 ees whose salaries are below the midpoint of their pay grade or occupational
11 groups with significant turnover rates shall be considered first in the order
12 of salary savings distributions.
