  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND ENCOURAGING THE DEPARTMENT  OF  HEALTH
  3        AND  WELFARE  TO COLLABORATE WITH STAKEHOLDERS TO CONVENE A TASK FORCE FOR
  4        THE PURPOSE OF DEVELOPING A FAMILY-DIRECTED SERVICE DELIVERY SYSTEM.
                                                                        
  5    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  6        WHEREAS, many Idaho families rely on Medicaid for  long-term  services  to
  7    meet the needs of their children with developmental disabilities; and
  8        WHEREAS, growth in the Medicaid budget requires all opportunities for sav-
  9    ings  to be explored, including strategies for families to make the most effi-
 10    cient and effective use of supports  and  services  for  their  children  with
 11    developmental disabilities; and
 12        WHEREAS,  many  families who have children with developmental disabilities
 13    want to have authority over service decisions that enable them to provide sup-
 14    port for their children at home; and
 15        WHEREAS, families who have children with developmental disabilities should
 16    control a limited amount of dollars that can be used flexibly to acquire  nec-
 17    essary supports; and
 18        WHEREAS,  the  state  of  Idaho  has  made progress in designing a service
 19    delivery system for adults with developmental disabilities that  permits  con-
 20    sumer choice and control; and
 21        WHEREAS,  Idaho  can  utilize  the lessons learned in the development of a
 22    self-directed system for adults to build a similar system  for  families  with
 23    minor age children; and
 24        WHEREAS,  all  families  who have children with developmental disabilities
 25    are valued partners in policymaking pertaining to  their  children's  services
 26    and supports.
 27        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
 28    of  the  Fifty-ninth  Idaho  Legislature, the House of Representatives and the
 29    Senate concurring therein, that the Legislature encourages the  Department  of
 30    Health and Welfare to collaborate with the Idaho Council on Developmental Dis-
 31    abilities  and  other  stakeholders to convene a task force for the purpose of
 32    developing a family-directed service delivery system.
 33        BE IT FURTHER RESOLVED, that the Legislature supports including  the  par-
 34    ticipation  of  families  who  have  children with developmental disabilities,
 35    appropriate public agencies, service providers and advocates in  the  develop-
 36    ment of this service delivery system.
 37        BE  IT FURTHER RESOLVED, that the Legislature encourages the Department of
 38    Health and Welfare to submit a request to the federal Centers for Medicare and
 39    Medicaid Services for approval to allow families to  direct  state  plan  ser-
 40    vices.
 41        BE  IT FURTHER RESOLVED, that the Legislature recommends that this service
 42    delivery system would be available  to  families  of  eligible  children  with
 43    developmental  disabilities,  would cost no more on average than services cur-
 44    rently available through the Medicaid state plan for children with developmen-

  1    tal disabilities, would include  an  individual  budget  driven  by  a  child-
  2    centered, family-directed plan, and would allow families to negotiate for ser-
  3    vices  and  supports  from  traditional  and nontraditional providers with the
  4    assistance of a support broker and a fiscal agent.
  5        BE IT FURTHER RESOLVED, that the Legislature requests that the  Department
  6    of  Health  and  Welfare  report its progress on this effort, including a cost
  7    analysis, to the Legislature by March 1, 2008.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

                             RS 16870

This resolution encourages the Department of Health and Welfare,
in collaboration with the Council on Developmental Disabilities, 
to convene a task force to design and develop a Medicaid model
that would permit families of minor children with developmental
disabilities a different way of receiving services.  The services
would be based on need as determined by a child-centered,
family-directed plan and would cost no more, on average, than the
present costs for these services for the same number of children. 
The work of this task force would build on preliminary study done
of this issue as the result of direction from 2006 legislative
intent language affixed to the Medicaid appropriation. 
Implementation of this model will require the Department of
Health and Welfare to submit a request to the federal Centers on
Medicaid and Medicare for approval.


                           FISCAL NOTE

This model will be developed by a group of individuals convened
by the Department of Health and Welfare in collaboration with the
Council on Developmental Disabilities.  Costs for meetings and
other work associated with the planning outlined in this
resolution are estimated to be $49,500.00 and will be covered
with operating funds of the Department of Health and Welfare, the
Idaho Council on Developmental Disabilities and other supporting
stakeholder organizations.
