  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING A CERTAIN RULE OF THE  IDAHO
  3        BOARD OF NURSING.
                                                                        
  4    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  5        WHEREAS,  the  Legislature  is  vested  with authority to reject executive
  6    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  7    that the Legislature finds that the rules are not consistent with  legislative
  8    intent; and
  9        WHEREAS,  it  is the finding of the Legislature that a certain rule of the
 10    Idaho Board of Nursing is not consistent with legislative intent and should be
 11    rejected.
 12        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
 13    of the Fifty-ninth Idaho Legislature, the House  of  Representatives  and  the
 14    Senate  concurring  therein,  that IDAPA 23.01.01, Rules of the Idaho Board of
 15    Nursing, Section 100, relating to Grounds for Discipline, Subsection 12, Fail-
 16    ure to Cooperate With Authorities, only, Rules of the Idaho Board of  Nursing,
 17    as  adopted  as  a  pending rule under Docket Number 23-0101-0601, be, and the
 18    same is hereby rejected and declared null, void and of no force and effect.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 17028

This concurrent resolution would reject a subsection of a pending
rule of the Idaho Board of Nursing pertaining to Rules of the
Idaho Board of Nursing. The effect of this resolution, if adopted
by both houses, would be to prevent this subsection of the agency
rule from going into effect.


                           FISCAL NOTE

This concurrent resolution has no fiscal impact.
