]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 21 BY EDUCATION COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING PENDING RULES OF THE DEPART- 3 MENT OF HEALTH AND WELFARE GOVERNING THE IDAHO CHILD CARE PROGRAM (ICCP). 4 Be It Resolved by the Legislature of the State of Idaho: 5 WHEREAS, the Legislature is vested with authority to reject executive 6 agency rules under the provisions of Section 67-5291, Idaho Code, in the event 7 that the Legislature finds that the rules are not consistent with legislative 8 intent; and 9 WHEREAS, it is the finding of the Legislature that certain rules of the 10 Department of Health and Welfare Governing the Idaho Child Care Program (ICCP) 11 are not consistent with legislative intent and should be rejected. 12 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 13 of the Fifty-ninth Idaho Legislature, the House of Representatives and the 14 Senate concurring therein, that IDAPA 16.06.12, Rules of the Department of 15 Health and Welfare, Rules Governing the Idaho Child Care Program (ICCP), 16 adopted as pending rules under Docket Number 16-0612-0601 (Chapter Repeal), 17 the entire rulemaking docket, be, and the same is hereby rejected and declared 18 null, void and of no force and effect.
STATEMENT OF PURPOSE RS 17029 This concurrent resolution would reject a pending rule of the Department of Health and Welfare pertaining to Rules Governing the Idaho Child Care Program (ICCP). The effect of this resolution, if adopted by both houses, would be to prevent the agency rule from going into effect. FISCAL NOTE This concurrent resolution has no fiscal impact. Contact Name: Rep.
