  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING PENDING RULES OF  THE  DIVI-
  3        SION OF BUILDING SAFETY.
                                                                        
  4    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  5        WHEREAS,  the  Legislature  is  vested  with authority to reject executive
  6    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  7    that the Legislature finds that the rules are not consistent with  legislative
  8    intent; and
  9        WHEREAS,  it  is  the finding of the Legislature that certain rules of the
 10    Division of Building Safety are not consistent  with  legislative  intent  and
 11    should be rejected.
 12        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
 13    of  the  Fifty-ninth  Idaho  Legislature, the House of Representatives and the
 14    Senate concurring therein, that IDAPA  07.03.01,  Rules  of  the  Division  of
 15    Building  Safety,  adopted  as pending rules under Docket Number 07-0301-0601,
 16    the entire rulemaking docket, be, and the same is hereby rejected and declared
 17    null, void and of no force and effect.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 17053

This concurrent resolution would reject a pending rule of the
Division of Building Safety pertaining to Rules of Building
Safety.  The effect of this resolution, if adopted by both
houses, would be to prevent the agency rule from going into
effect.
