  2    RELATING TO FISH AND GAME; AMENDING SECTION 36-409, IDAHO CODE, TO PROVIDE FOR
  3        WILDLIFE MANAGEMENT AREA (WMA) UPLAND GAME BIRD PERMITS AND TO MAKE  TECH-
  4        NICAL  CORRECTIONS;  AND AMENDING SECTION 36-416, IDAHO CODE, TO PROVIDE A
  5        FEE FOR WMA UPLAND GAME BIRD PERMITS.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 36-409, Idaho Code, be, and the  same  is  hereby
  8    amended to read as follows:
                                                                        
  9        36-409.  GAME  TAGS -- PERMITS -- FEES -- PENALTY. (a) Resident Game Tags.
 10    A resident who has obtained a permit to hunt, as provided in  section  36-401,
 11    Idaho  Code,  or  has  purchased or obtained a license to hunt, as provided in
 12    section 36-406, Idaho Code, upon payment of the fees provided herein shall  be
 13    eligible  to  receive  a  resident  game tag to hunt and kill a moose, bighorn
 14    sheep, mountain goat, elk, deer, antelope, mountain lion, bear, sandhill crane
 15    or turkey in accordance with the laws of this state and rules  promulgated  by
 16    the  commission; provided further, that any person who holds a senior resident
 17    combination license or any person who holds a junior  combination  or  hunting
 18    license  or  any  disabled  American  veteran who holds a disabled combination
 19    license, may be issued a bear, deer, elk, or turkey tag for a fee as specified
 20    in section 36-416, Idaho Code; provided further, that resident game  tags  may
 21    be  issued only to those persons who meet residency requirements of subsection
 22    (s) of section 36-202, Idaho Code. In the event an emergency  is  declared  to
 23    open   a   season   to   protect  private  property  as  provided  in  section
 24    36-106(e)6.(B), Idaho Code, the affected landowner or his  designee  shall  be
 25    eligible  to receive a resident deer, elk or antelope tag without charge; pro-
 26    vided further, that resident game tags may be issued only to persons who qual-
 27    ify as residents pursuant to section 36-202, Idaho Code.
 28        (b)  Nonresident Game Tags. A nonresident who has purchased a  license  to
 29    hunt,  as  provided in section 36-407(a) or (k), Idaho Code, or has obtained a
 30    license to hunt, as provided in section 36-406(e), Idaho Code, or  a  resident
 31    who  has  purchased  or  obtained  a  license  to hunt, as provided in section
 32    36-406, Idaho Code, upon payment of the fees provided herein, shall be  eligi-
 33    ble  to  receive  a  nonresident  tag to hunt and kill a moose, bighorn sheep,
 34    mountain goat, elk, deer, antelope, mountain lion,  bear,  sandhill  crane  or
 35    turkey  in accordance with the laws of this state and rules promulgated by the
 36    commission; provided further that a nonresident who has purchased a license to
 37    hunt, as provided in section 36-407(k),  Idaho  Code,  shall  be  eligible  to
 38    receive  a  junior mentored deer, elk, bear, or turkey tag for a fee as speci-
 39    fied in section 36-416, Idaho Code.
 40        (c)  Game Tags Required. The appropriate tag must be had for  the  hunting
 41    or taking of each and every one of the aforementioned wildlife. Provided, how-
 42    ever,  that the requirements for a mountain lion tag or a bear tag, as to dif-
 43    ferent periods of time and areas of the state, shall be determined and  speci-

  1    fied  by  the commission. Provided further, that the commission may promulgate
  2    rules to allow a nonresident deer tag to be used to hunt  and  kill  either  a
  3    bear  or a mountain lion during the open season for deer in that area, unit or
  4    zone as may be specified by the commission. All of said tags are to  bear  and
  5    have serial numbers.
  6        (d)  Game Tag to Be Validated and Attached to Carcass. As soon as any per-
  7    son  kills  any  wildlife  for which a tag is required, said tag, belonging to
  8    him, must be validated  and attached to said wildlife in a manner provided  by
  9    commission rule.
 10        (e)  Archery  Permits. In addition to meeting the license and tag require-
 11    ments provided in this chapter, any person participating in any controlled  or
 12    general  game season which has been specifically designated as an archery hunt
 13    must have in his possession an archery hunt permit which may be  purchased  at
 14    for a fee as specified in section 36-416, Idaho Code.
 15        (f)  Muzzleloader  Permit.  In  addition  to  meeting  the license and tag
 16    requirements provided in this chapter, any person participating  in  any  con-
 17    trolled  or  general  game  season which has been specifically designated as a
 18    muzzleloader hunt must have in his possession a muzzleloader permit which  may
 19    be purchased at for a fee as specified in section 36-416, Idaho Code.
 20        (g)  Hound  Hunter  Permit  -- Resident -- Nonresident. Any person using a
 21    dog for the purpose of hunting or for taking, as defined  in  section  36-202,
 22    Idaho Code, big game or furbearing animals must have in his possession a valid
 23    hound hunter permit which may be purchased by resident and nonresident license
 24    holders for a fee as specified in section 36-416, Idaho Code.
 25        (h)  Nonresident  Bird  of  Prey Capture Permit. The commission may, under
 26    rules as it may prescribe, issue a nonresident bird of  prey  capture  permit.
 27    This capture permit may be purchased by any licensed, nonresident falconer for
 28    capturing birds of prey in Idaho. The fee for the permit shall be as specified
 29    in section 36-416, Idaho Code, and the permit shall be issued under the condi-
 30    tion  that  the  nonresident's  home  state allows reciprocal raptor capturing
 31    privileges for Idaho falconers.
 32        (i)  Wildlife Management Area (WMA) Pheasant Upland Game Bird Permit.  The
 33    commission  may,  under rules as it may prescribe, issue a wildlife management
 34    area pheasant upland game bird permit that must be purchased  by  all  persons
 35    over  sixteen (16) years of age prior to hunting pheasants stocked upland game
 36    birds on state wildlife management areas designated by the commission. The fee
 37    for the permit shall be as specified in section 36-416, Idaho Code.
 38        (j)  Bear Baiting Permit. The commission may, under rules as it  may  pre-
 39    scribe,  issue  a bear baiting permit. Any person placing or using bait as may
 40    be allowed by rule for the purpose of attracting bear must have in his posses-
 41    sion a valid bear baiting permit which may be purchased by  a  license  holder
 42    for a fee as specified in section 36-416, Idaho Code.
 43        (k)  Migratory  Bird  Harvest  Information  Program Permit. The commission
 44    may, as provided by federal laws or regulations and under rules as it may pre-
 45    scribe, issue a migratory bird harvest information program permit that must be
 46    purchased by all persons prior to hunting migratory game birds as required  by
 47    federal  law  or regulations.  The fee for the permit shall be as specified in
 48    section 36-416, Idaho Code.
 49        (l)  Dog Field Trial Permit. The commission may, under  rules  as  it  may
 50    prescribe,  issue  a  dog field trial permit to any person using birds for dog
 51    field trials or training as may be allowed by rule. The  permit  may  be  pur-
 52    chased for a fee as specified in section 36-416, Idaho Code.
 53        (m)  Idaho  Nursing  Home Facility Resident Fishing Permit. The commission
 54    may, under rules as it may prescribe, issue an  Idaho  nursing  home  facility
 55    resident fishing permit that must be purchased by an Idaho nursing home facil-

  1    ity to allow residents of its facility to fish during the open season. Facili-
  2    ties  eligible  to purchase this permit are: intermediate care facilities pro-
  3    viding twenty-four (24) hour skilled nursing care, assisted living  facilities
  4    providing  twenty-four  (24)  hour  extensive  assistance  and skilled nursing
  5    facilities providing twenty-four (24) hour skilled nursing. By purchasing this
  6    permit the facility assumes full responsibility   for  and  control  over  the
  7    facility  residents  while using the permit. All laws, rules and proclamations
  8    apply to the use of this permit and it is the responsibility of  the  facility
  9    to  assure  compliance  with  all  laws, rules and proclamations. In case of a
 10    violation the facility shall be held accountable and any  citations  shall  be
 11    issued  to the facility. The permit may be purchased for a fee as specified in
 12    section 36-416, Idaho Code.

Statement of Purpose / Fiscal Impact


                   STATEMENT OF PURPOSE

                         RS 16454

Currently, a Wildlife Management Area (WMA) pheasant permit is 
required to hunt pheasants on certain WMAs where pheasants are 
stocked to expand hunter opportunity on these high use areas.  
The permit allows hunters to contribute to the cost of stocking 
pheasants and it allows harvest monitoring because each 
harvested bird must be recorded on the permit. 

This legislation would expand the scope of the WMA pheasant 
permit to include other stocked game bird species, primarily 
chukar.  Expanding the scope of the permit would enhance hunter 
opportunity by adding additional species and it could increase 
the time period for pursuing stocked birds on WMAs, because 
chukar season lasts longer than pheasant season.


                       FISCAL NOTE

This legislation would expand the scope of the current WMA 
pheasant permit to include other stocked game bird species but 
it would not change the price, which is $22.00 excluding vendor 
fee.  Sales of the WMA pheasant permit have been relatively 
stable and averaged 5,086 permits over the last five calendar 
years for annual revenue of $111,892.  Hunters can buy multiple 
permits through the season, although the majority of hunters 
(generally over 90%) only buy one permit.  Idaho Department of 
Fish and Game projects that expanding the scope of the permit 
will not increase sales more than 10%.  Sales would probably be 
generated by an increase in multiple permit sales due to 
additional species and a longer season.  If permit sales 
increase 10%, then on average, an additional 509 permits would 
generate an additional $11,198 in revenue each year.  Currently, 
rearing and stocking pheasants costs about $180,000 excluding 
Department staff time.  With expansion of the scope of the 
permit, Idaho Department of Fish and Game expects to generally 
reallocate current program costs to accommodate other game bird 
species in addition to pheasants, not substantially increase 
current expenditures to rear and stock game birds.
