]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE SENATE SENATE BILL NO. 1023 BY JORGENSON 1 AN ACT 2 RELATING TO WORKER'S COMPENSATION; AMENDING CHAPTER 7, TITLE 72, IDAHO CODE, 3 BY THE ADDITION OF A NEW SECTION 72-701A, IDAHO CODE, TO PROHIBIT CERTAIN 4 RETALIATORY ACTIONS AND TO PROVIDE PENALTIES. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Chapter 7, Title 72, Idaho Code, be, and the same is 7 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 8 ignated as Section 72-701A, Idaho Code, and to read as follows: 9 72-701A. RETALIATORY ACTIONS. (1) No employer may discharge, discriminate 10 or in any other manner retaliate against an employee who has given notice and 11 made a claim, or is about to give notice and make a claim, under the worker's 12 compensation law of this state, or any employee who has testified, or is about 13 to testify, in any proceeding related to such a claim. 14 (2) An employer who violates this section shall be liable for such legal 15 or equitable relief as may be appropriate to effectuate the purposes of this 16 section, including without limitation, employment, reinstatement, promotion, 17 and the payment of wages lost, and an additional equal amount as liquidated 18 damages.
