STATE CAPITOL BUILDING RENOVATION - LEGISLATIVE SESSION - Amends existing
law to provide that during the Capitol Building renovation, the Legislature
will hold its organizational session in the Capitol Building or in the
building in which the Legislature will hold sessions; to provide for
members' expenses; to provide that during the State Capitol Building
renovation or during relocation due to an emergency, state moneys shall be
kept in a vault within the Office of the State Treasurer's temporary
location and, upon completion, these moneys shall be kept in a vault in the
Capitol Building; and to provide that certain furniture during renovation
of the Capitol Building shall be kept in temporary space approved by the

  1                                        AN ACT
  2    RELATING TO THE RENOVATION OF THE STATE  CAPITOL  BUILDING;  AMENDING  SECTION
  3        67-404a, IDAHO CODE, TO PROVIDE THAT THE LEGISLATURE WILL HOLD ITS ORGANI-
  4        ZATIONAL  SESSION IN THE CAPITOL BUILDING OR IN THE BUILDING  IN WHICH THE
  5        LEGISLATURE WILL  HOLD  SESSIONS,  TO  PROVIDE  FOR  PAYMENT  OF  MEMBERS'
  6        EXPENSES  AND  TO  MAKE  A TECHNICAL CORRECTION; AMENDING SECTION 67-1204,
  7        IDAHO CODE, TO PROVIDE THAT DURING THE STATE CAPITOL  BUILDING  RENOVATION
  8        OR  DURING RELOCATION DUE TO AN EMERGENCY, STATE MONEYS SHALL BE KEPT IN A
  9        VAULT WITHIN THE OFFICE OF THE STATE TREASURER'S  TEMPORARY  LOCATION  AND
 10        UPON  COMPLETION  THESE  MONEYS  SHALL  BE  KEPT IN A VAULT IN THE CAPITOL
 11        BUILDING; AMENDING SECTION 67-1608, IDAHO CODE, TO  PROVIDE  THAT  CERTAIN
 12        FURNITURE  DURING RENOVATION OF THE CAPITOL BUILDING SHALL BE KEPT IN TEM-
 13        PORARY SPACE APPROVED BY THE CAPITOL COMMISSION; AND  DECLARING  AN  EMER-
 14        GENCY.
                                                                        
 15    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 16        SECTION  1.  That  Section 67-404a, Idaho Code, be, and the same is hereby
 17    amended to read as follows:
                                                                        
 18        67-404a.  ORGANIZATION OF HOUSE OF  REPRESENTATIVES  AND  SENATE.  On  the
 19    first Thursday of December in general election years, the members-elect of the
 20    house  of representatives and senate shall meet at the state capitol in Boise,
 21    in the capitol  building or, during any renovation of the capitol building, in
 22    the building in which the legislature will hold sessions, for the  purpose  of
 23    organizing  their  respective houses. Members-elect shall each receive the sum
 24    of $25.00 per day not to exceed three (3) days for general expenses, and shall
 25    also be reimbursed for actual and necessary travel  and  lodging  expenses  in
 26    attending  such meetings. The members-elect attending such meetings shall file
 27    with the legislative  council  a  duly  verified  claim,  together  with  paid
 28    vouchers  for  travel  and lodging expenses actually incurred. The legislative
 29    council shall file all such claims with the appropriate state office for exam-
 30    ination and payment of all just claims compensation and expenses authorized by
 31    the citizen's committee on legislative compensation, which shall be paid  from
 32    the legislative account.
                                                                        
 33        SECTION  2.  That  Section 67-1204, Idaho Code, be, and the same is hereby
 34    amended to read as follows:
                                                                        
 35        67-1204.  MONEY TO BE KEPT IN VAULT -- PENALTY. (1) All  state  moneys  in
 36    the  custody  of the state treasurer not otherwise deposited or invested as is
 37    or may be by law provided by law, shall be kept in the  vault and safe as pro-
 38    vided for that purpose in the capitol building and in no other place.
 39        (2)  During the capitol building  renovation,  beginning  in  fiscal  year
 40    2007, or during relocation due to an emergency, these same moneys as set forth
 41    above,  shall  be  kept  in a vault within the office of the state treasurer's

  1    temporary location. Upon completion of this renovation, the provisions of sub-
  2    section (1) of this section shall apply.
  3        (3)  A violation of this section shall subject the state  treasurer,  upon
  4    conviction  thereof,  to  pay  a  fine  of not less than five thousand dollars
  5    ($5,000) nor more than ten thousand dollars ($10,000), or to  imprisonment  in
  6    the  state prison for a period of not less than one (1) nor more than ten (10)
  7    years, or to both such fine and imprisonment.
                                                                        
  8        SECTION 3.  That Section 67-1608, Idaho Code, be, and the same  is  hereby
  9    amended to read as follows:
                                                                        
 10        67-1608.  POWERS  AND  DUTIES OF THE COMMISSION. The commission shall have
 11    the following powers and duties:
 12        (1)  In consultation with the director of the  department  of  administra-
 13    tion,  to  develop a comprehensive, multiyear, master plan ("master plan") for
 14    the restoration and refurbishment of the capitol building and to review  peri-
 15    odically,  and,  as appropriate, to amend and modify the plan. The master plan
 16    shall address long-range modifications and improvements to the capitol  build-
 17    ing and its grounds.
 18        (2)  To develop and implement a program to fund the master plan.  The pro-
 19    gram shall include recommendations to the legislature for appropriating public
 20    moneys  as  well as a comprehensive strategy to obtain moneys from the private
 21    sector.
 22        (3)  To review all proposals to reconstruct,  redecorate  or  restore  all
 23    space  within the capitol building.  All such projects shall be in conformance
 24    with the master plan and may not be implemented without the written consent of
 25    the commission.
 26        (4)  To review all proposals involving objects of art, memorials, statues,
 27    or exhibits to be placed on a permanent or temporary  basis  in  public  space
 28    within  the capitol building or on its grounds. All proposals shall be in con-
 29    formance with the master plan and may not be implemented without  the  written
 30    consent of the commission.
 31        (5)  To identify all furniture original to the capitol building and create
 32    an  inventory of the original furniture. The possession of all original furni-
 33    ture used within the public and executive department space shall  be  retained
 34    by  the  director  of  the department of administration. The possession of all
 35    original furniture used by the legislative department shall be retained by the
 36    presiding officers of the senate and house of representatives.   All  original
 37    furniture  is the property of the state of Idaho and shall remain in the capi-
 38    tol building at all times or, during renovation of the  capitol  building,  in
 39    temporary space approved by the commission.
 40        (6)  For  the  purpose  of  promoting interest in the capitol building and
 41    obtaining funds to enhance the preservation of original and historic  elements
 42    of  the  capitol building and its grounds, to develop and implement a plan for
 43    the publishing and sale of publications on the history of the capitol building
 44    and to develop other capitol building memorabilia for sale to the public.
 45        (7)  To solicit gifts, grants or donations of any kind from any private or
 46    public source to carry out the purposes of this chapter.  All gifts, grants or
 47    donations received directly by the commission  shall  be  transmitted  to  the
 48    state  treasurer  who shall credit the same to the capitol endowment fund cre-
 49    ated by this chapter.
 50        (8)  To request necessary assistance from all state agencies and the  pre-
 51    siding  officers  of the senate and house of representatives in performing its
 52    duties pursuant to this chapter.
 53        (9)  To enter into agreements with tax-exempt nonprofit organizations  for

  1    the purpose of assisting the commission in the performance of its duties under
  2    this  chapter,  including  agreements for the establishment and maintenance of
  3    community foundation funds dedicated to the purposes of this chapter.
  4        (10) To appoint and contract with the architect of the capitol building as
  5    provided by this chapter.
                                                                        
  6        SECTION 4.  An emergency existing  therefor,  which  emergency  is  hereby
  7    declared to exist, this act shall be in full force and effect on and after its
  8    passage and approval.

                       STATEMENT OF PURPOSE

                            RS 16547C1

During the restoration and construction of garden level atrium
wings, the capitol building will be unoccupied.  The legislature
will not be able to meet in the building and movable items, such as
the vault in the office of the treasurer and furniture, cannot
remain in the building during construction.  The legislation makes
changes to Idaho Code to recognize and accommodate the construction
process.  This change will involve amending sections in title 67,
chapters 4, 12, and 16.
